Rezoning Request - A&W Investment Group, Inc. <br />The Planning Board unanimously recommends approval of A&W <br />Investment Group's petition to rezone 81.47 acres of land located <br />on the northern side of Peach Orchard Road beginning at a point <br />approximately 2800 feet east of the intersection of Rocky Fork <br />Chruch Road and Peach Orchard Road from Residential Agricultural <br />District to Residential Mixed Conditional Use District for the <br />location of a major subdivision with approximately 17 lots on the <br />property, restricting the types of manufactured homes permitted on <br />the property to Class A and Class B manufactured homes. The board <br />recommends that the approval be conditional upon an easement being <br />provided by A&W Investment Group to the adjoining Tysinger <br />property crossing lot 8 as sketched on the map proposed during the <br />public hearing. The Planning Board in its deliberation cited the <br />current use of the neighboring properties for manufactured homes, <br />the restrictions placed on the property by the developer, and the <br />large lot sizes being proposed. <br />4. Final Subdivision Plat - Winding Creek Farm Subdivision, <br />Section 5 <br />The Planning Board unanimously approved the final plat of <br />Winding Creek Farm Subdivision, Section 5, which is being <br />developed by Van Harris. The eight subdivision lots, which are <br />approximately one acre in size, will be served by individual <br />septic tanks and a private water system which has been approved by <br />the Department of Environment, Health, and Natural Resources. The <br />subdivision road will be paved and built to DOT standards. The <br />Planning Board recommends BOC approval of the subdivision subject <br />to the developer providing a bond or letter of credit in the <br />amount of $31,350 to guarantee completion of the street and water <br />line improvements. <br />5. Tabled Rezoning Request - Karl Lewis <br />upon considering whether additional information was necessary <br />to make a recommendation to the Board of Commissioners concerning <br />Karl Lewis's tabled petition to rezone approximately 387 acres of <br />land located at the intersection of Colon Road and U.S. Highway 1 <br />from Residential Agricultural District to Light Industrial <br />Conditional Use District for the location of a planned business <br />development with industrial, child care, and recreational <br />facilities, as well as billboard advertisement on the property, <br />a majority of the Planning Board stated that they did not feel <br />that an additional public hearing is warranted. The Planning <br />Board also maintained their initial recommendation to deny the <br />petition which they felt was based on sound planning principles. <br />The Planning Board felt that an industrial development the <br />magnitude of Mr. Lewis' proposal is clearly not in keeping with <br />the residential and agricultural integrity of the area, and is <br />obviously not in compliance with the Lee County Land Development <br />Plan which designates the area "Low Density Residential and <br />Agricultural." The board felt that the development would be more <br />appropriately located in an industrial park or on other vacant <br />land which currently zoned Light or Heavy Industrial.
