with any appropriate agency or the pursuit of other remedies <br />shall not impair an individuals right to a prompt and <br />equitable resolution of his or her complaint under this <br />grievance procedure. Furthermore, the filing of a lawsuit in <br />state or federal court can occur at any time. <br />Commissioner Cox seconded the motion, and upon a vote, the <br />results were as follows: <br />Aye: Cox, Hall, Paschal, Reives, Stafford and Wicker <br />Nay: None <br />The Chairman ruled the motion had been adopted unanimously. <br />The Board considered a Resolution to establish an Americans <br />With Disabilities Act (ADA) Compliance Committee. After some <br />discussion commissioner Cox moved to adopt the following <br />Resolution: <br />BE IT RESOLVED BY THE BOARD OF COMMISSIONERS AS FOLLOWS: <br />Section I. There is hereby created an Americans With <br />Disabilities Act (ADA) Compliance Committee to consist of five <br />members. Membership of this committee shall consist of one <br />elected official, one private citizen from the disabled <br />community, one private citizen from business or non-profit <br />sector, one private citizen from the field of education, and <br />one private citizen from the health care/medical profession. <br />Three of the initial appointees hold office until June 30, <br />1993, and two initial appointees shall hold office until June <br />30, 1994. Thereafter, all appointments shall be for two <br />years, or until their successors are appointed and qualified. <br />Section II. The Americans With Disabilities Act (ADA) <br />Compliance Committee shall convene after its appointment and <br />select a chairman. Thereafter, at its first meeting following <br />January 1st of each year it shall select a member to serve as <br />chairman. The chairman shall preside at all meetings and <br />shall be responsible for calling all meetings of the <br />committee. Meetings shall be held from time to time as <br />necessary and three members of the committee shall constitute <br />a quorum. Members of the committee shall serve without <br />compensation. The County shall provide clerical support to <br />the committee to perform such duties as the committee shall <br />direct. <br />Section III. The ADA Compliance Committee shall conduct <br />hearings at the request of disabled persons who feel Lee <br />County has discriminated against him or her in providing <br />access to and participation in public facilities, services, <br />activities, and functions. <br />Section IV. The three initial appointees who shall hold <br />office until June 30, 1993, are Commissioner Nathan E. <br />Paschal, Bob Hales and Rusty Hodges. <br />31 <br />
