002 <br />couy <br />MEMORANDUM eAR ° <br />TO: Lee County Board of Commissioners <br />Lee County Planning Board <br />John Crumpton, County Manager <br />FROM: Marshall Downey, Assistant Director of Planning and Development <br />DATE: April 18, 2011 <br />REF: Public Hearing regarding several corrective amendments to the Unified <br />Development Ordinance (UDO) based on recommendation from the North <br />Carolina Division of Emergency Management. <br />The North Carolina Division of Emergency Management recently conducted a Community <br />• Assistance Visit (CAV) for the City of Sanford as part of the National Flood Insurance <br />Program (NFIP). The purpose of a CAV is to ensure that local officials have the appropriate <br />rules and procedures in place to ensure compliance with the NFIP. This is done locally <br />through Article 13 of the UDO, the Flood Hazard Area Regulations. <br />Mr. Steve Garrett of NCDEM met with local Planning staff and conducted the CAV visit on <br />behalf of FEMA. Subsequently, Mr. Garrett followed up with a letter that summarizes his <br />Sanford visit (a copy of which is attached). Included in his assessment (beginning on page <br />3), are recommended changes to Article 13 of the UDO. <br />These changes include: <br />• 13.4.4.1 appears to combine the final as -built elevation certificate and an interim <br />elevation certificate within 21 days of the reference level being completed. It may be <br />necessary to identify these requirements separately. Sample language is available in <br />the State Model Ordinance and can be provided to the community. <br />• 13.8.4.1.2 does not include text from Article 5, Section D(2)(b) of the State Model <br />Ordinance. Please add "When floodway or non - encroachment data is available from a <br />Federal, State, or other source, all new construction and substantial improvements <br />within floodway and non - encroachment areas shall also comply with the requirements <br />of 13.8.2 and 13.8.6." <br />• 13.4.4.3 should reference 13.8.2.1.3 rather than Article 5, Section B(3). <br />• 13.5.1(e) should reference 13.8.6 rather than 13.8.5. <br />• 13.5.1(u) should reference 13.3.2 instead of Article 3, Section B. <br />
