013 QTA�T` v�:: NIr)QTW r'I\Qr - )l I.NIA FRANCHISE AGREEMENT COUNTY OF LEE ) This Franchise Agreement, made and entered into on the day of , 2011, by and between the County of Lee, one of the counties of the State of North Carolina, and a body both politic and corporate, hereinafter called the Grantor and CALL, LLC, doing business as Central Stump Dump, a limited liability company organized and existing under the laws of the State of North Carolina, with its principle office in Lee County, North Carolina, hereinafter called the Grantee. RECITALS WHEREAS, the Board of Commissioners of Lee County (Board) meeting in its regular meetings on March 21, 2011, and April 4, 2011, took action to authorize a franchise for a landfill for land clearing and inert debris (LCID) to CALL, LLC, doing business as Central Stump Dump; and WHEREAS, the Grantee has complied with the requirements of the County's Unified Development Ordinance and its Landfill Ordinance, the notification requirements of the Department of Environment and Natural Resources (NCDENR), and • WHEREAS, the Grantee represents that it is in compliance with all known requirements; and WHEREAS, the Solid Waste Superintendent has reported that the County's landfill requirements have been met; and WHEREAS, the Planning and Development has issued its official notice approving this project for planning and zoning purposes; and WHEREAS, the parties hereto agree as follows: SECTION ONE For and in consideration of the covenants herein contained and as stipulated in its application and related documents, the payment of the annual application fee to the Grantor, Grantor gives and grants to Grantee a franchise and the right to develop, operate and maintain landfills of various sizes for the land disposal of land clearing debris and inert debris on a tract of land containing 13.83 acres at Goldsboro Avenue, Sanford, North Carolina. •
