013 <br />QTA�T` v�:: NIr)QTW r'I\Qr - )l I.NIA <br />FRANCHISE AGREEMENT <br />COUNTY OF LEE ) <br />This Franchise Agreement, made and entered into on the day of <br />, 2011, by and between the County of Lee, one of the counties of the <br />State of North Carolina, and a body both politic and corporate, hereinafter called the <br />Grantor and CALL, LLC, doing business as Central Stump Dump, a limited liability <br />company organized and existing under the laws of the State of North Carolina, with its <br />principle office in Lee County, North Carolina, hereinafter called the Grantee. <br />RECITALS <br />WHEREAS, the Board of Commissioners of Lee County (Board) meeting in its <br />regular meetings on March 21, 2011, and April 4, 2011, took action to authorize a <br />franchise for a landfill for land clearing and inert debris (LCID) to CALL, LLC, doing <br />business as Central Stump Dump; and <br />WHEREAS, the Grantee has complied with the requirements of the County's <br />Unified Development Ordinance and its Landfill Ordinance, the notification requirements <br />of the Department of Environment and Natural Resources (NCDENR), and <br />• WHEREAS, the Grantee represents that it is in compliance with all known <br />requirements; and <br />WHEREAS, the Solid Waste Superintendent has reported that the County's <br />landfill requirements have been met; and <br />WHEREAS, the Planning and Development has issued its official notice <br />approving this project for planning and zoning purposes; and <br />WHEREAS, the parties hereto agree as follows: <br />SECTION ONE <br />For and in consideration of the covenants herein contained and as stipulated in <br />its application and related documents, the payment of the annual application fee to the <br />Grantor, Grantor gives and grants to Grantee a franchise and the right to develop, <br />operate and maintain landfills of various sizes for the land disposal of land clearing <br />debris and inert debris on a tract of land containing 13.83 acres at Goldsboro <br />Avenue, Sanford, North Carolina. <br />• <br />
