Proctor, Jr. <br />and the undersigned to the point of intersection with <br />the western right of way boundary of survey line L, <br />said point being 55 feet northeasterly of and normal <br />to survey line L; thence S. 16 degrees, 03 feet, 33 <br />inches W. to the point of beginning. <br />Being the same and identical tracts of land described in and <br />conveyed by that certain deed dated the 4th day of September, 1992, <br />from the State of North Carolina to the County of Lee which is <br />recorded in book number Z168 on page .Z,, et seq. in the office of <br />the Register of Deeds for Lee County, North Carolina, to which deed <br />reference is hereby made for greater certainty of description. <br />But these tracts or parcels of land are conveyed subject to <br />certain restrictions, covenants, and conditions as set out in the <br />following conservation agreement as to the use thereof, running with <br />said land by whomsoever owned, said conservation agreement being <br />assented to by the Grantee by acceptance of this deed. The terms, <br />conditions, restrictions, and covenants of said conservation <br />agreement are as follows: <br />1. The property hereby conveyed will be used by the Grantee <br />and all subsequent owners only in connection with the camelback truss <br />bridge (bridge #155) over Deep River near the Village of Cumnock. <br />2. The property hereby conveyed will be retained in its <br />natural scenic and open condition except that shrubbery may be <br />planted, flower gardens may be planted, recreational areas such as <br />picnic grounds may be constructed, a parking lot may be constructed, <br />foot trails may be constructed as nature trails and as a means of <br />access to the camelback tress bridge over Deep River and to the <br />recreational areas. <br />
