Hoyle <br />STATE OF NORTH CAROLINA ) <br />COUNTY OF LEE ) <br />nin 14 88S <br />QUITCLAIM DEED <br />13 <br />THIS QUITCLAIM DEED, made this the ,Z day of September, 1992, <br />by and between the COUNTY OF LEE, a political subdivision of the <br />State of North Carolina and a body both politic and corporate under <br />the laws of the State of North Carolina, hereinafter referred to as <br />the GRANTOR, and the DEEP RIVER PARR ASSOCIATION, a non-profit <br />corporation chartered under the laws of the State of North Carolina, <br />with its registered office located at 205 Courtland Drive, Sanford, <br />NC, hereinafter referred to as GRANTEE, <br />WITNESSETH: <br />WHEREAS, the State of North Carolina conveyed the lands <br />hereinafter described to Grantor by a deed dated September 4, 1992, <br />which is recorded in Book 48 , Page OLz , Lee County Registry; and <br />WHEREAS, North Carolina General Statute§ 153A-176 authorizes a <br />county to dispose of real property belonging to it according to the <br />procedures prescribed in Chapter 160A, Article 12, General Statute of <br />North Carolina; and <br />WHEREAS, North Carolina General Statute §160A-266, which is a <br />part of Article 12, Chapter 160A of said statute, authorizes a county <br />to dispose of real property by private negotiation and sale where the <br />said real estate is significant for its relationship to other real <br />property which is significant for its architectural , archaeological, <br />artistic, cultural or historical associations or where said real <br />property is significant for its natural, scenic or open condition; <br />and where said real property is to be sold to a non-profit <br />corporation whose purposes include the preservation or conservation <br />of real property of architectural, archaeological, artistic, <br />cultural, historical, natural or scenic significance; and where a <br />preservation agreement or conservation agreement as defined in North <br />Carolina General Statute §121-35 is placed in the deed conveying said <br />property from the County to the non-profit corporation; and <br />WHEREAS, the Deep River Park Association is a non-profit <br />corporation chartered by the State of North Carolina under the <br />provisions of North Carolina General Statute §55A; and <br />WHEREAS, the specific purposes for which said corporation was <br />formed are to promote environmental awareness, seek recreational <br />areas for the public use, to promote conservation and environmental <br />protection for areas along Deep River as it runs through Lee and <br />Chatham County, North Carolina, and any other lawful activity <br />permitted a non-profit corporation; and <br />WHEREAS, the Deep River Park Association has or will acquire <br />from the State of North Carolina the camelback truss bridge <br />(bridge #155) over Deep River near the Village of Cumnock; and <br />
