Roos 11 r, 1002 <br />14 <br />pending judicial action or administrative proceeding in <br />which the county or an officer or employee of the <br />county is a party or in which the board finds that the <br />county has a substantial interest. The terms of any <br />settlement discussed in executive session and actually <br />agreed to by all parties shall be reported to the board <br />in open session and entered into its minutes within a <br />reasonable time after settlement is concluded. <br />6. To consult with an attorney to the extent that <br />confidentiality is required for the attorney to <br />exercise his or her ethical duties as a lawyer. <br />7. To consider the qualifications, competence, <br />performance, character, fitness, conditions of <br />appointment, or conditions of initial employment of a <br />county officer or employee or a prospective county <br />officer or employee. Final action appointing, <br />employing, removing, or discharging a county officer or <br />employee shall be taken in open session. <br />8. To consider the employment, performance, or <br />discharge of an independent contractor. Final <br />decisions regarding such employment or discharge shall <br />be taken in open session. <br />9. To hear or investigate a complaint, charge, or <br />grievance by or against a county officer or employee. <br />Final action regarding such complaint, charge, or <br />grievance shall be taken in open session. <br />10. To consider the appointment or removal of a <br />member of another board, commission, or other public <br />body, some or ail of whose members are appointed by the <br />Lee County Board of Commissioners. At least seven days <br />before making an appointment discussed previously in <br />executive session, the board shall present at an open <br />meeting and simultaneously make available for public <br />inspection in the office of the clerk to the board a <br />written list of the persons then under consideration <br />for the appointment. Final action on appointments to <br />and removal from other boards, commissioners, or other <br />public bodies shall be taken in open session. <br />11. To consider information when state or federal law <br />directs that the information be kept confidential or <br />makes the confidentiality of the information a <br />condition of state or federal aid. <br />12. To consider and adopt contingency plans for <br />dealing with, and consider and take action relating to, <br />strikes, slow downs, or other collective employment <br />interruptions. <br />13. To consider and take action necessary to deal <br />with a riot or civil disorder or with conditions <br />-2- <br />
