Ep
Memo
To: John Crumpton, Lisa Minter
From: Bob Heuts
Date: July 6, 2007
Re: Industrial Park
Status of Corps of Engineers issue at Industrial Park
A. Compliance Issues
1. Lee County is out of compliance of its Nationwide 404 permit for
construction of road and sewer at the Park.
2. Draft letter submitted to Corps of Engineers and Division of Water
Quality for compliance of Nationwide Permit 14 (attached).
3. Need a stream mitigation plan for restoring impacted stream and
completion of mitigation items listed in the draft proposal.
4. Submit application for 401 permit to NC Division of Water Quality
concurrent with remediation plan of the Corps of Engineers.
B. Wetlands Certification
1. Survey all identified wetlands
2. Survey boundary of Industrial Park
Compliance issues listed under "A" need to be completed to avoid potential
permitting problems for future projects and fines. MS Consultants and other
engineering firms have suggested that the draft letter response to the Corp of
Engineers be revisited and revised to avoid having to construct a bridge over an
impacted stream.
There are substantial costs associated with the compliance issues. The
wetlands certification including survey work will also be costly and will need to be
done as soon as possible. The other suggests looking at the property
comprehensively and re-negotiating with the Corp of Engineers for options other
than building a bridge. We do not know what building a bridge would cost.
® 226 CARTHAGE STREET
PO BOX 1968
SANFORD NC 27331-1968
9191774-8439 FAX 919/775-5410
e-mail: info(a)lcedc.com web page: www.lcedc.com
