® 3 <br />soo 15 ?APE 14 <br />The Board considered a resolution ratifying appointments to the <br />Social Services Board. Commissioner Garner moved to approve the <br />following resolution: <br />RESOLUTION <br />WHEREAS, North Carolina General Statute 10BA-4 provides in part <br />that "each member of a County Board of Social Services shall serve <br />for a term of three (3) years..."; and <br />WHEREAS, if the Board of Commissioners appoints one of its <br />members to the Social Services Board, that persons term is three (3) <br />years even if the term as commissioner ends earlier; and <br />WHEREAS, pursuant to North Carolina General Statute 108A-5, the <br />term of the member of the County Board of Social Services appointed <br />by the Board of Commissioners shall expire on June 30, 1983, and <br />every three (3) years thereafter which would mean that reappointment <br />should have been made on June 30th in 1986, 1989, and 1992; and <br />WHEREAS, Commissioner William C. Stafford, Jr., was appointed to <br />the Lee County Social Services Board on December 3, 1990, and has <br />held office since that date; and <br />WHEREAS, no reappointment was made on June 30, 1992, and <br />therefore Commissioner Stafford held office pursuant to N.C. General <br />Statute 128-7 which provides that an appointee continues to hold <br />office until his successor is appointed and qualifies; and <br />WHEREAS, Commissioner Stafford has resigned his appointment as a <br />member of the Lee County Social Services Board effective as of <br />December 20, 1992; and <br />WHEREAS, Commissioner John R. Dossenbach, Jr., was appointed by <br />the Chairman to serve as a member of the Lee County Social Services <br />Board on December 21, 1992, and a question has arisen about the <br />length of said term of office since under North Carolina General <br />Statute 108A-6 all appointments are for the remainder of the former <br />members term of office; and <br />WHEREAS, The Board of Commissioners desires to ratify said <br />appointment and establish the term of such appointment for the <br />remainder of the statutory term; <br />NOW, THEREFORE, Be It Resolved by the Board of Commissioners for <br />Lee County as follows: <br />Section 1: The appointment of Commissioner John R. <br />Dossenbach, Jr., as a member of the Lee County Social Services Board <br />3 <br />
