$DO1 1S~AS= 1~~ 29 <br />County property or right-of-way the Company shall enter into <br />encroachment agreements with the County and file plans and <br />specifications before installation and as-built drawings after <br />installation. If the County requests any services to be removed from <br />its property or rights-of-way because of conflict of encroachment <br />between the County and the Company, the Company will remove the same, <br />at its own cost, within a reasonable time. <br />SECTION 4. The system shall be maintained and operated to <br />render efficient service and, in order to so do, the Company shall <br />have the right to prescribe service rules and regulations for the <br />conduct of its business not inconsistent with the provisions of this <br />ordinance, provided, however, that the system will be operated so <br />that there will be no interference with television reception, radio <br />reception, telephone communications or other installations which are <br />now or may hereafter be installed and in use by the County or any <br />person within the County. <br />SECTION 5. The rates for installation of equipment and regular <br />subscriber services shall be as set forth in Appendix A. <br />SECTION 6. No increase in rates charged for installation of <br />equipment and regular subscriber services as specified in Appendix A <br />shall be made effective except as authorized by the Board of <br />Commissioners of the County of Lee after an appropriate public <br />proceeding affording due process. <br />Recognizing the pendency of court litigation and Congressional <br />legislation at the time of the passing of this ordinance which may <br />impose copyright liability on all or part of the cable television <br />service rendered by the Company in the County, and further <br />recognizing the uncertainty and jeopardy which such potential <br />liability places upon the Company, should such copyright liability be <br />imposed by any court or by the Congress, the Company shall have the <br />right to increase its rates for regular subscriber services in order <br />to offset such copyright liability. Any increase in the Company's <br />rate schedule pursuant to this paragraph shall be limited to the <br />amount of the copyright liability imposed. Such increase shall not <br />be subject to the procedures specified in the preceding paragraph and <br />shall become effective 30 days after notice of such increase is given <br />to the Board of Commissioners together with a certification that the <br />increase is due solely to the imposition of copyright liability and <br />that the increase is limited to an amount necessary to cover the <br />amount of the copyright liability. <br />Rates for services other than the installation of equipment and <br />regular subscriber services, including, but not limited to, <br />advertising, leased channels, and other auxiliary services, shall be <br />established by the Company pursuant to the rules of the Federal <br />Communications Commission. <br />SECTION 7. The Company shall provide free installation of one <br />drop to each public school within the area served of the County of <br />Lee. Additional public school drops shall be installed and billed at <br />the Company's cost. There shall be no monthly service charge for the <br />first drop in each public school.
