Qoo 1S~.e~ 1~;..; <br />25 <br />AN ORDINANCE GRANTING A NON-EXCLUSIVE <br />FRANCHISE TO NOVA MEDICAL TRANSPORT, INC. <br />FOR THE PROVISION OF NON-EMERGENCY AND CONVALESCENT <br />AMBULANCE SERVICE IN LEE COUNTY, NORTH CAROLINA <br />The Lee County Board of Commissioners does ordain as follows: <br />Section I. The Board of Commissioners of Lee County, North <br />Carolina, does hereby find, declare and determine as follows: <br />1. That after due deliberation, in open session, at its <br />regular meetings held on May 3, 1993, and May 17, 1993, the Board <br />determined that there was a need for non-emergency and convalescent <br />ambulance services in Lee County. The Board thereupon voted to award <br />a non-exclusive franchise to Nova Medical Transport, Inc. for the <br />provision of non-emergency and convalescent ambulance services in Lee <br />County. <br />2. Pursuant to Section 4 of the "Ordinance Regulating <br />Ambulance Services in Lee County" Nova Medical Transport, Inc. has <br />made application for a franchise from Lee County to operate a <br />non-emergency and convalescent ambulance service in Lee County. <br />3. Nova Medical Transport, Inc. is in compliance with Article <br />7 of Chapter 131E of the North Carolina General Statutes. <br />4. Nova Medical Transport, Inc. is entitled to have such a <br />franchise granted, and the granting of such a franchise is necessary <br />to assure the provision of continuing non-emergency and convalescent <br />ambulance service in Lee County and will promote the public health, <br />safety and welfare. <br />5. The procedures of Gen. Stat. 153A-250, Gen. Stat. 153A-45, <br />and Gen. Stat. 153A-46 have been complied with. <br />Section II. Nova Medical Transport, Inc. is hereby granted <br />the non-exclusive permission and franchise to operate a non-emergency <br />and convalescent ambulance service (be an ambulance provider) in Lee <br />County upon the terms and conditions set forth herein. <br />Section III. Nova Medical Transport, Inc. shall at all times <br />be in compliance with Article 7 of Chapter 131E of the North Carolina <br />General Statutes. Failure to maintain such compliance shall <br />automatically terminate the franchise herein granted. Said Article 7 <br />sets forth standards for ambulances, equipment and personnel. <br />Section IV. This franchise shall exist and continue for a <br />period of one year from the date the franchise is granted, unless <br />earlier terminated as herein set forth. <br />
