HOYLE <br />County Attorney <br />Telephone 774-8437 <br />FAX 774-8407 <br />RESOLUTION ACCEPTING THE ENFORCEMENT OF THE REQUIRED <br />WATERSHED PROTECTION REGULATIONS WITHIN THE TOWN OF BROADWAY <br />AND THE TOWN OF BROADWAY'S EXTRATERRITORIAL JURISDICTION <br />WHEREAS, in accordance with G.S. 143-214.5, the Town of <br />Broadway must provide a water supply watershed management and <br />protection program consistent with minimum statewide management <br />requirements established by the North Carolina Environmental <br />Management Commission; and <br />WHEREAS, all affected municipalities with a population less <br />than 5,000 persons must adopt a water supply watershed management <br />and protection program by October 1, 1993, and all counties must <br />adopt a similar program by January 1, 1994; and <br />WHEREAS, a portion of the Cape Fear WS-IV Watershed is <br />located in the extraterritorial jurisdiction of the Town of <br />Broadway; and <br />WHEREAS, the Town of Broadway currently contracts with the <br />County of Lee to provide planning and inspections services within <br />the Town of Broadway's town limits and within the Town of <br />Broadway's extraterritorial jurisdiction; and <br />WHEREAS, the Town of Broadway Board of Commissioners has <br />adopted a resolution allowing the County of Lee to enforce all <br />required watershed protection regulations within the Town of <br />Broadway's town limits and within the Town of Broadway's <br />exraterritorial jurisdiction; <br />NOW, THEREFORE, BE IT RESOLVED BY THE LEE COUNTY BOARD OF <br />COMMISSIONERS that the County of Lee hereby accepts enforcement of <br />all state mandated water supply watershed management and <br />protection requirements for affected areas within the Town of <br />Broadway's town limits and the Town of Broadway's extraterritorial <br />jurisdiction, and that such enforcement will commence upon the <br />adoption date of the County of Lee's water supply watershed <br />management and protection program which must be in effect by <br />January 1, 1994. <br />),IQ <br />ted this day of 1993. <br />AI''. <br />Wirilam C.
