0 <br />boas 15 34 7 <br />ARTICLE III <br />Operation <br />Section 3.1 Shelter. Society has constructed, <br />operates and maintains within Lee County, an animal shelter <br />which complies with all applicable statutes, building codes and <br />regulations including, but not limited to Chapter 19A of the <br />General Statutes of North Carolina. <br />(a) In the event the Society ceases to exist, it agrees <br />to transfer ownership of the said animal shelter to a <br />non-profit organization acceptable to the County of <br />Lee and the Society, to be used for purposes <br />consistent with the Society's present goals; provided <br />in such event the County shall have option to <br />terminate this contract immediately; provided further <br />that if the Society fails to find or transfer title <br />to such non-profit corporation, the County shall have <br />the option to acquire fee simple title for itself by <br />paying outstanding encumbrances. <br />(b) The County agrees that should it acquire title to the <br />facility, that it shall continue to operate the <br />facility as an animal shelter and that it will not <br />allow Central Carolina Community College to control <br />or to obtain animals from the facility. <br />Section 3.2 Non-Discriminatory. Society will operate <br />the animal shelter for the use and benefit of the citizens of <br />Lee County and other citizens or groups of citizens the Society <br />deems appropriate, and make such available on fair, equal and <br />non-discriminatory prices and further, that in the operation and <br />use of said facility the Society will not, on the grounds of <br />race, color or national origin, discriminate or permit <br />discrimination against any person or groups of persons in any <br />manner. <br />Section 3.3 Injured Animals. During the hours of <br />8:00 a.m. to 5:00 p.m., Monday - Friday, of each week except for <br />legal holidays, the County animal control officers shall be <br />responsible for picking up all injured animals and administering <br />appropriate disposition. During all other hours the Society <br />shall pick up said injured animals for a charge of $15.00 per <br />animal, which charge shall be in addition to the service fee <br />hereinafter stated. <br />Section 3.4 Charges of Services. County agrees that <br />Society may set fees for services in connection with the <br />operation of said shelter and Society agrees that the fees set <br />will be reasonable and commensurate with the expense of <br />providing such service and the time and investment required. <br />12 <br />
