10 <br />sous 345 <br />STATE OF NORTH CAROLINA ) <br />COUNTY OF LEE ] <br />CONTRACT <br />THIS AGREEMENT, made and entered into as of the 30th day <br />of June, 1993, by and between SAN-LEE HUMANE SOCIETY, INC., a <br />North Carolina Corporation with its principal office and place <br />of business in Lee County, North Carolina (the "Society") ; and <br />the COUNTY OF LEE, North Carolina, a political subdivision and a <br />body corporate of the State of North Carolina (the "County") ; <br />W I T N E S 8 E T H: <br />WHEREAS, the County operates an animal control program <br />pursuant to a County ordinance which is enforced by an animal <br />control officer; and <br />WHEREAS, the Society has agreed to operate and maintain an <br />animal shelter and perform other services in connection <br />therewith; and <br />WHEREAS, the County will make appropriations for such <br />services pursuant to North Carolina General Statute 153-442; and <br />WHEREAS, both parties desire a written memorandum of their <br />agreement; <br />NOW, THEREFORE, in consideration of the premises, the <br />respective representations, the mutual promises herein contained <br />and the sums to be paid, it is mutually agreed as follows: <br />ARTICLE I <br />Definitions <br />Section 1.1 Definitions. In addition to the works <br />and terms elsewhere herein, the following words shall have the <br />respective meanings set forth below: <br />(1) "Animal Control officer" has the meaning as used in <br />the North General Statutes and County Ordinance and <br />includes the term "dog warden". <br />(2) "Animal Shelter" means a facility which is used to <br />house or contain animals and which is owned, operated <br />or maintained by a duly incorporated humane society. <br />(3) "County" means the County of Lee, State of North <br />Carolina. <br />(4) "Society" means the San-Lee Humane Society, Inc. <br />(5) "State" means the State of North Carolina. <br />
