aooK y1'S Frat 591 013 STATE OF NORTH CAROLINA AGREEMENT COUNTY OF LEE This Agreement made and entered into on the day of , 1994, by and between the COUNTY OF LEE, one of the counties of the State of North Carolina and a body both politic and corporate, hereinafter referred to as "County", and the CITY OF SANFORD, a municipal corporation of the State of North Carolina, hereinafter referred to as "City"; WITNESSETH: WHEREAS, City operates and maintains a municipal water system which has extended into some areas of Lee County; and WHEREAS, County has received a petition from residence in the area of Southern Road seeking the establishment of a special assessment district pursuant to Article 9, Chapter 153A of the General Statutes of North Carolina for the purpose of extending a water system into their area; and WHEREAS, County is willing to establish such a district for that purpose and the City is willing to extend its water lines and provide water to the residence of that area; NOW, THEREFORE, it is mutually agreed between the County and the City as follows: 1. County will finance the extension of a water line into the Southern Road Special Assessment District and will pay to the City the contract price for such extension within ten (10) days of notification of the acceptance of the lowest responsible bid. Likewise, County will pay to the City within ten (10) days of the receipt of an invoice from City stating the amount of any change order executed by the City and its contractor which has been determined to be necessary by the City's Public Works Department. 2. The County will establish a special assessment district in accordance with Article 9, Chapter 153A of the General Statutes of North Carolina and assess the benefitted properties as provided therein. 3. City will design, construct and maintain said water line in the Southern Road Special Assessment District and will furnish water to the residents of said area and shall be entitled to all tap-on fees and charges for the use of water.
