0 Boos 15 r:e< 6201 ~RESOLUTION AUTHORIZING THE ADVERTISEMENT <br />OF AN OFFER TO PURCHASE CERTAIN PROPERTY <br />WHEREAS, the Board of Commissioners for the County of Lee <br />desires to dispose of certain surplus property of the County; <br />NOW, THEREFORE, BE IT RESOLVED by the Board of commissioners <br />that: <br />1. The following described property is hereby declared to be <br />surplus to the needs of the County; <br />Lying and being in Cape Fear Township, Lee County, N.C., <br />and more particularly described as follows: <br />BEGINNING at an iron stake in the southeastern <br />line of the 33 acre tract described in deed dated <br />April 20, 1950, executed by W.J. Hunter to L.K. <br />Hunter and wife, Altie Hunter, 150 feet south of <br />the southeast corner of the one acre lot of H.M. <br />Thomas and wife, Louise Thomas described in deed <br />recorded in Deed Book 63, Page 523, Lee County <br />Registry, and running thence as the southeast <br />line of said 33 acre tract South 24 degrees West <br />110 feet to a stake; thence North 64 degrees West <br />210 feet to a stake; thence North 24 degrees East <br />110 feet to a stake; thence South 64 degrees East <br />210 feet to the BEGINNING, containing one-half <br />acre, more or less. <br />2. The Board of Commissioners has received an offer to <br />purchase for the sum of $400.00 the property described above. <br />3. The Board of Commissioners proposes to accept the offer <br />unless an upset bid shall be made. <br />4. The person making the offer shall deposit with the Lee <br />County Finance officer a sum equal to five percent (5%) of his offer <br />which is $20.00, plus advertising costs in the amount of $40.00, <br />which shall not be applied to the purchase price. Said deposit will <br />be retained by the County in the event that the offerer shall fail to <br />pay the balance of the purchase price within ten (10) days after <br />notice that he is the successful bidder. If an upset bid is received <br />within the time allowed by law, the deposit shall be returned to the <br />party making the deposit; provided, however, the amount paid for <br />advertising costs shall not be refunded. <br />5. After receipt of the deposit, the Clerk to the Board shall <br />cause a notice of such offer to be published in accordance with N.C. <br />Gen. Stat. 160A-269 and Gen. Stat. 153A-176. The notice shall <br />contain a provision that a party raising a bid by the statutory <br />amount shall pay an advertising fee of $40.00, which will not be <br />applied to the purchase price nor will it be refunded. <br />026 <br />
