®o 15 Pn~ 692 <br />Aye: Dossenbach, Garner, Paschal, Reives and Stafford <br />Nay: None <br />The Vice Chairman ruled the motion had been adopted unanimously. <br />The Board considered a recommendation from the Planning Board, <br />which was discussed at the last meeting. Planning Director Trevis <br />Averett gave the Board an update on the rezoning request from Willie <br />Godfrey. After some discussion commissioner Stafford moved to deny <br />the Planning Boards recommendation and approved the request to rezone <br />the property. Upon a vote, the results were as follows: <br />Aye: Dossenbach, Garner, Paschal, Reives and Stafford <br />Nay: None <br />The Vice Chairman ruled the motion had been adopted unanimously. <br />The Board considered a recommendation from the Building, Grounds <br />and Utilities Committee concerning the Lee County Arts Center. <br />Commissioner Paschal, Chairman of the Committee, moved that since the <br />Board deems the former high school building, presently known as the <br />Lee County Community and Arts Center, to be significant for its <br />architectural, artistic, cultural, or historical associations, that <br />it make the following offer to any group interested in the <br />preservation of such structure: <br />1. That the County would enter into negotiations with such <br />a group for the private sale of the building and a portion of the <br />adjoining property as authorized by General Statute 160A-266 and <br />General Statute 153A-176 and subject to the following conditions. <br />2. That the property would be sold for a nominal value to <br />a non-profit corporation whose purposes include the preservation of <br />real property of architectural, artistic, cultural, and historical <br />significance. <br />3. That the deed of conveyance contain restrictive <br />covenants or other legally binding restrictions which would promote <br />the preservation of the property and where appropriate, secure rights <br />of public access, and which will qualify as a preservation agreement <br />as defined by General Statute 121-35. <br />4. That the estate or interest to be conveyed be a fee <br />simple determinable so that title to the property reverts to the <br />County if the grantee or subsequent owner violates the terms of the <br />preservation agreement. <br />5. That any such interested group respond to this offer <br />within ninety (90) days of the date of this meeting and that copies <br />of this offer be mailed to Mr. Tommy C.
