800k 16 PKs 150 <br />approval of a resolution authorizing refund for guarantee for <br />manufactured home foundation enclosure. Commissioner Cox moved to <br />approve the following resolution: <br />RESOLUTION AUTHORIZING REFUND OF PERFORMANCE <br />GUARANTEES AFTER COMPLIANCE WITH THE MANUFACTURED <br />HOME FOUNDATION ENCLOSURE REQUIREMENTS OF THE <br />ZONING ORDINANCE OF LEE COUNTY <br />WHEREAS, Article XIII, of the Zoning Ordinance of Lee County, <br />North Carolina, Section 3 provides that owners of Class A, Class B, <br />and Class C manufactured homes when installing a masonry foundation <br />enclosure may apply for a temporary occupancy permit to allow them to <br />occupy such residences prior to completion of the foundation <br />enclosure required by Article IV, Section 2 or Article VI, Section 5; <br />and <br />WHEREAS, temporary occupancy shall be permitted for a period not <br />to exceed sixty (60) days after all other local and State Building <br />codes have been complied with; and <br />WHEREAS, a performance guarantee in an amount fixed by the Board <br />of County Commissioners and which is currently fixed at $250 must be <br />posted by the owners to ensure compliance with this Section; and <br />WHEREAS, the owners in making application for the temporary <br />occupancy permit agree to reimburse Lee County for any reinspection <br />costs which are necessary to ensure compliance with this Section. <br />NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of <br />Lee County: <br />Section 1. That upon completion and approval of the <br />required foundation enclosure, the performance guarantee posted <br />pursuant to Article XIII, Section 3 of the Zoning Ordinance of Lee <br />county is to be refunded to the owners less any reinspection fees, <br />court costs, fines or other penalties and costs incurred by the <br />County of Lee in ensuring compliance with said Section. <br />Section 2. That the County Manager and appropriate staff <br />be, and they hereby are, authorized and directed to disburse refunds <br />in accordance with this resolution and other applicable regulations <br />and policies of Lee County. <br />Commissioner Reives seconded the motion, and upon a vote, the results <br />were as follows: <br />Aye: Cox, Dossenbach, Garner, Matthews, Moretz and Reives <br />Nay: None <br />The Chairman ruled the motion had been adopted unanimously. <br />013 <br />6 <br />
