The Board considered the transfer of title to the old Sanford-Lee County Airport property to the Sanford-Lee County Regional Airport Authority. Airport Authority Chairman Herb Hincks was present and answered questions of the Board. After some discussion Commissioner Moretz moved to approve the following: RESOLUTION AUTHORIZING TRANSFER OF TITLE TO OLD SANOFRD-LEE COUNTY AIRPORT PROPERTY TO THE SANFORD-LEE COUNTY REGIONAL AIRPORT AUTHORITY WHEREAS, the Sanford-Lee County Regional Airport Authority (Authority) was created by the General Assembly of North Carolina on July 9, 1992, at the request of the Board of Aldermen for the City of Sanford (City) and the Board of Commissioners for Lee County (County); and WHEREAS, the operation of the present Sanford-Lee County Airport was delegated to the Sanford-Lee County Regional Airport Authority by resolutions adopted by both Boards in 1992; and WHEREAS, the Grant Agreement dated March 22, 1994, which modified the original Grant Agreement dated February 2, 1993, between the Authority and the Department of Transportation, an agency of the State of North Carolina, provides that upon the formal opening of the new Sanford-Lee County Airport, the Authority agrees that it will close and sell the old Sanford-Lee County Airport, and credit the sales price in accordance with Federal procedures; and WHEREAS, the title to the land, rights in land, easements, appurtenances, and personal property comprising the old Sanford-Lee County Airport is vested in the City of Sanford and the County of Lee; and WHEREAS, the Authority has requested the City and County to convey title to all real and personal property comprising the old Sanford-Lee County Airport to the Authority in order for it to comply with the terms of said Grant Agreement; and WHEREAS, N.C. General Statute I60A-274 authorizes a county, upon such terms and conditions as it deems wise, with or without consideration, to sale to a governmental unit, which includes an authority, any interest in real or personal property that it may own; and WHEREAS, there has been submitted to this meeting forms of the following documents: • Deed from the City and County to the Authority for their right, title, and interest in and to the real property comprising the old Sanford-Lee County Airport; and • Bill of Sale from the City and County to the Authority for the personal property belonging to or which is a part of the old Sanford-Lee County Airport; and WHEREAS, the County desires and deems it expedient to convey its interest in said property to the Authority with consideration; NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners for the County of Lee as follows:
