That after due deliberation, in open session, at its regular meetings held on <br />October 7, 1996, and October 21, 1996, the Board determined that there was a need for <br />non-emergency and convalescent ambulance services in Lee County. The Board <br />thereupon voted to award a non-exclusive franchise to American Medical Response, Inc. <br />for the provision of non-emergency and convalescent ambulance services in Lee County. <br />2. Pursuant to Section 4 of the "Ordinance Regulating Ambulance Services in <br />Lee County" American Medical Response, Inc. has made application for a franchise from <br />Lee County to operate a non-emergency and convalescent ambulance service in Lee <br />County. <br />3. American Medical Response, Inc. is in compliance with Article 7 of <br />Chapter 13IE of the North Carolina General Statutes. <br />4. American Medical Response, Inc. is entitled to have such a franchise <br />granted, and the granting of such a franchise is necessary to assure the provision of <br />continuing non-emergency and convalescent ambulance service in Lee County and will <br />promote the public health, safety and welfare. <br />5. The procedures ofN.C. Gen. Stat. 153A-250, 153A-45, and 153A-46 have <br />been complied with. <br />Section H. American Medical Response, Inc. is hereby granted the non- <br />exclusive permission and franchise to operate a non-emergency and convalescent <br />ambulance service (be an ambulance provider) in Lee County upon the terms and <br />conditions set forth herein. <br />Section III. American Medical Response, Inc. shall at all times be in compliance <br />with Article 7 of Chapter 131E of the North Carolina General Statutes. Failure to <br />maintain such compliance shall automatically terminate the franchise herein granted. Said <br />Article 7 sets forth standards for ambulances, equipment and personnel. <br />Section IV. This franchise shall exist and continue for a period of one year from <br />the date the franchise is granted, unless earlier terminated as herein set forth. <br />Section V. American Medical Response, Inc. is authorized to provide <br />ambulance services in the following ambulance service area: Sanford and all of Lee <br />County, North Carolina. <br />Section VI. It will be the responsibility of American Medical Response, Inc. to <br />dispatch its own ambulances. American Medical Response, Inc. will maintain and <br />disseminate its telephone number (toll free) so that the same will be accessible to its <br />patrons. Upon receipt of call by the Lee County Emergency Communications Center for <br />assistance of non-emergency or convalescent ambulance service request, the requester will <br />4 <br />
