50V 16 Pn F 966 <br />094 <br />AN ORDINANCE GRANTING FRANCHISES <br />TO <br />AMISUB OF NOTH CAROLINA, INC. <br />DOING BUSINESS AS CENTRAL CAROLINA HOSPITAL <br />FOR THE PROVISION OF EMERGENCY AND NON-EMERGENCY <br />AMBULANCE SERVICE IN LEE COUNTY, NORTH CAROLINA <br />Section I. The Board of Commissioners of Lee County, North Carolina <br />does hereby find, declare and determine as follows: <br />a) That after due deliberation, in open session, at its regular meetings held <br />on June 2, 1997, and , 1997, the Board determined that there was a <br />need for emergency and non-emergency ambulance services in Lee County. The <br />Board thereupon voted to award an exclusive franchise to AMISUB of North <br />Carolina, Inc. d/b/a Central Carolina Hospital (hereinafter referred to as Central <br />Carolina Hospital) for the provision of emergency ambulance services in Lee County <br />and a non-exclusive franchise to Central Carolina Hospital for the provision of non- <br />emergency and convalescent ambulance services in Lee County. <br />b) Pursuant to Section 4 of the "Ordinance Regulating Ambulance <br />Services in Lee County", Central Carolina Hospital has made application for a <br />franchise from Lee County to operate an emergency and non-emergency ambulance <br />service in Lee County. <br />C) Central Carolina Hospital is in compliance with Article 7 of Chapter <br />131E of the North Carolina General Statutes. <br />d) - Central Carolina Hospital is entitled to have such franchises granted <br />and the granting of such franchises is necessary to assure that provision of continuing <br />emergency and non-emergency ambulance service in Lee County and wilt promote the <br />public health, safety, and welfare. <br />e) The procedures of GS 153A-2650, GS 153A-45, and GS 153A-46 <br />have been complied with. <br />Section II. Central Carolina Hospital is hereby granted the exclusive <br />permission and franchise to operate an emergency ambulance service and the non- <br />exclusive permission and franchise to operate a non-emergency and convalescent <br />ambulance service in Lee County upon the terms and conditions set forth herein. <br />Section III. Central Carolina Hospital shall at all times be in compliance <br />with Article 7 of Chapter 131E of the North Carolina General Statutes. Failure to <br />maintain such compliance shall automatically terminate the franchise herein granted. <br />4 <br />
