<br />THIS LICENSE AGREEMENT made, effective as of July 28, 1997,
<br />by and between the County of Lee, one of the counties of North
<br />Carolina, and a body both politic and corporate under the laws of
<br />North Carolina, and the City of Sanford, a North Carolina
<br />municipal corporation, hereinafter referred to as LICENSORS, and
<br />the Lee County Board of Education, a body corporate under the
<br />laws of the State of North Carolina, hereinafter referred to as
<br />LICENSEE.
<br />WITNESSETH:
<br />Whereas, by virtue of an instrument dated July 16, 1976, and
<br />recorded in book 281, Page 950, Lee County Registry, the County
<br />of Lee has a 20-foot wide sewer line easement located in Deep
<br />River Township, Lee County, North Carolina, and hereinafter
<br />described; and
<br />Whereas, by virtue of an instrument dated June 29, 1984, and
<br />recorded in Book 358, Page 46, Lee County Registry, the City of
<br />Sanford also has the same 20-foot wide sewer line easement
<br />granted the county; and
<br />Whereas, by virtue of an instrument dated July 17, 1997, and
<br />recorded in Book 612, Page 285, Lee County Registry, the Lee
<br />County Board of Education also has the same 20-foot wide sewer
<br />line easement granted to the county and city; and
<br />Whereas, the Lee County Board of Education desires to
<br />acquire a license over, across, and under said 20-foot wide sewer
<br />line easement for the purpose of laying, operating and
<br />maintaining a sanitary sewer line.
<br />Now, therefore, LICENSORS, for the purposes aforesaid, and
<br />in consideration of the sum of $10.00 to them in hand paid, the
<br />receipt of which is acknowledged, do hereby grant to LICENSEE a
<br />perpetual license to occupy and use the 20-foot wide sewer line
<br />easement located in Deep River Township, Lee County, North
<br />Carolina, the center line of which is described as follows:
<br />Beginning at the lift station lot, more clearly
<br />described in Deed Book 281 Page 949 Lee County
<br />Registry, said beginning being Station 0 + 33 as shown
<br />on plans described below; thence N 53 degrees 05
<br />minutes W 172 feet to a point, said point being located
<br />20 feet northerly from the Right of Way of the Norfolk
<br />Southern Railroad; thence parallel and 20 feet off
<br />Right of Way N 68 degrees 07 minutes W 1160 feet;
<br />thence N 64 degrees 36 minutes W 190 feet; thence N 56
<br />degrees 27 minutes W 210 feet; thence N 49 degrees 17
<br />minutes W 225 feet; thence N 47 degrees 54 minutes 695
