17 024 <br />eao;t urs~ ill <br />STATE OF NORTH CAROLINA ) <br />COUNTY OF LEE ) <br />AGREEMENT <br />THIS AGREEMENT, made and entered into this day of October, 1997, by <br />and between the COUNTY OF LEE, one of the counties of the State of North Carolina <br />and a body both politic and corporate hereinafter referred to as the "County" and <br />RONALD MYRES, DVM, a citizen and resident of Lee County, North Carolina, <br />hereinafter referred to as "Dr. Myres"; <br />WITNESSETH: <br />WHEREAS, the Lee County Department of Health operates an animal control <br />program which utilizes tranquilizer guns for the purpose of capturing and removing <br />animals from their environment in a humane manner; and <br />WHEREAS, the Lee County Department of Health can only acquire the <br />necessary drugs for use in these guns by prescription from a veterinarian; and <br />WHEREAS, Dr. Myres is a veterinarian licensed to practice in North Carolina <br />and operates the Myres Animal Hospital, 1710 Westover Drive, Sanford, N.C., and in <br />addition serves as a member of the Lee County Board of Health; and <br />WHEREAS, Dr. Myres has offered to order and sell to the Lee County <br />Department of Health at his cost the drugs necessary for the operation of the tranquilizer <br />guns by the Health Department employees and has asked that the County indemnify him <br />for volunteering to provide such service. <br />NOW, THEREFORE, it is mutually agreed between the parties as follows: <br />1. Dr. Myres agrees to order and sell Ketimine, Rompun and ACE to the Lee <br />County Department of Health for use by its personnel in tranquilizing animals. <br />2. That the County agrees to reimburse Dr. Myres for the cost of these <br />medications. <br />3. That Lee County acknowledges that Dr. Myres exercises no supervision or <br />control of the use of said medications and agrees to save him safe and harmless from any <br />and all liability growing out of the Lee County Department of Health's possession and use <br />of said medications. <br />IN WITNESS WHEREOF, Lee County has caused this instrument to be executed <br />in the County's name by the Chairman of the Board of Commissioners and Clerk to the <br />
