aoox 17 rr~r_ b 012 <br />ARTICLE III <br />Operation <br />Section 3.1 Shelter. Society has constructed, operates and maintains within <br />Lee County, an animal shelter which complies with all applicable statutes, building codes <br />and regulations including, but not limited to, Chapter 19A of the General Statutes of <br />North Carolina. <br />a) In the event the Society ceases to exist, it agrees to transfer ownership <br />of said animal shelter to a non-profit organization acceptable to the <br />County of Lee and the Society, to be used for purposes consistent with <br />the Society's present goals; provided in such event the County shall <br />have option to terminate this contract immediately; provided further <br />that if the Society fails to find or transfer title to such non-profit <br />corporation, the County shall have the option to acquire fee simple title <br />for itself by paying outstanding encumbrances. <br />b) The County agrees that should it acquire title to the facility, that it shall <br />continue to operate the facility as an animal shelter and that it will not <br />allow Central Carolina Community College to control or to obtain <br />animals from the facility. <br />Section 3.2 Non-Discriminatory. Society will operate the animal shelter for the <br />use and benefit of the citizens of Lee County and other citizens or groups of citizens the <br />Society deems appropriate, and make such available on fair, equal and non-discriminatory <br />prices and further, that in the operation and use of said facility the Society will not, on the <br />grounds of race, color or national origin, discriminate or permit discrimination against any <br />person or groups of persons in any manner. <br />Section 3.3 Iniured Animals. During the hours of 8:00 a.m. to 5:00 p.m., <br />Monday - Friday of each week except for legal holidays, the County Animal Control <br />Officers shall be responsible for picking up all injured animals and administering <br />appropriate disposition. During all other hours the Society shall pick up said injured <br />animals for a charge of $15.00 per animal, which charge shall be in addition to the service <br />fee hereinafter stated. <br />Section 3.4 Charges of Services. County agrees that Society may set fees for <br />services in connection with the operation of said shelter and Society agrees that the fees <br />set will be reasonable and commensurate with the expense of providing such service and <br />the time and investment required. <br />Section 3.5 Audit. Society agrees that County may audit its books biannually <br />utilizing County personnel or an accounting firm employed by the County. Society agrees <br />
