GiG
these violations are established at either $100 per calendar day, per violation or $500 per calendar day,
• per violation. The franchise agreement allows the County, by resolution, to unilaterally adjust the
liquidated damage amounts "to take into account increases in the consumer price index." The
liquidated damage amounts have not been adjusted during the term of the franchise. According to Mr.
Talbert the United States Department of Labor, Bureau of Labor Statistics, has determined that in 1998,
the date of the agreement, $100 had the same buying power as $133.78 does in 2010. The Board was
asked to increase each $100 per day liquidated damage amount to $133.00 per day, per violation and
$500 per day liquidated damage amount to $668.00 per day. After discussion, Commissioner Paschal
moved to approve a Resolution Adjusting Liquidated Damage Amounts in Cable ITelevision Franchise
Agreement with Charter Communications, a copy of which is attached to theseIIminutes and by this
reference made a part hereof.
