The franchise agreement allows the County, by resolution, to unilaterally adjust the <br />liquidated damage amounts "to take into account increases in the consumer price index." The <br />liquidated damage amounts have not been adjusted during the term of the franchise. According to Mr. <br />Talbert the United States Department of Labor, Bureau of Labor Statistics, has determined that in 1998, <br />the date of the agreement, $100 had the same buying power as $133.78 does in 2010. The Board was <br />asked to increase each $100 per day liquidated damage amount to $133.00 per day, per violation and <br />$500 per day liquidated damage amount to $668.00 per day. After discussion, Commissioner Paschal <br />moved to approve a Resolution Adjusting Liquidated Damage Amounts in Cable Television Franchise <br />Agreement with Charter Communications, a copy of which is attached to these minutes and by this <br />reference made a part hereof. Upon a vote, the results were as follows: <br />Aye: Hayes, Oldham, Parks, Paschal, Reives, Shook, and Womack <br />Nay: None <br />The Chairman ruled the motion had been adopted unanimously. <br />With no further business to come before the Board, Commissioner Reives moved to adjourn the <br />meeting.
