LEASE AGREEMENT <br />BETWEEN COUNTY OF LEE <br />AND <br />BROADWAY BASEBALL LEAGUE <br />This Lease is made by and between the County of Lee (hereinafter referred to as "Landlord"), a <br />body both politic and corporate of the State of North Carolina, and Broadway Baseball League <br />(hereinafter referred to as "Tenant"). <br />WHEREAS, the parties hereto have mutually agreed to the terms and conditions of this lease <br />agreement as hereinafter set out. <br />NOW, THEREFORE, in consideration of the premises and the mutual covenants and conditions as <br />stated herein, Landlord does hereby lease unto Tenant and Tenant hereby takes and leases from <br />Landlord during the period of time and subject to the terms and conditions hereinafter set out, more <br />particularly described as follows: <br />1. Premises <br />The Gilbert Lett Family Park, located at 100 Gilbert Lett Drive, Broadway North Carolina, which <br />includes the two ball fields, dug outs, spectator stands and concessions building. <br />2. Lease Term <br />The term of this lease shall be month to month until terminated by either party providing notice <br />in writing to the other parry. <br />3. Use and Operation of Tenant's Business <br />The leased space will be for the use of the Tenant's intent of providing park and recreation <br />services to the citizens of Lee County. The Tenant can use the leased space for the purpose of <br />running baseball, softball and flag football leagues. Tenant shall coordinate with the Lee County <br />Parks and Recreation Director to schedule all events and practices. All event scheduled for the <br />Gilbert Lett Family Park shall be maintained by the Lee County Parks and Recreation <br />Department. Failure to comply with the schedule coordination terms through the Parks and <br />Recreation Department can result in termination of the event by the Landlord. Tenant will be <br />permitted to sell concessions and depending on the menu being offered may need inspections <br />by Environmental Health. It will be the duty of the Tenant to work with Environmental Health to <br />determine whether permits are or are not needed. Concession proceeds will be kept by Tenant <br />to help cover costs of running the leagues. Tenant understands Landlord reserves the right to <br />use the premises as well for its own park purposes and Tenant agrees that all uses of the <br />premises shall be for public park purposes only. <br />1 <br />
