Review of Letter from NC Department of Transportation for Widening of NC 42 and
Relocation of Graves at Shallow Well Church
County Manager John Crumpton stated that a letter was received on February 13,
2018 from an NC DOT right of way agent informing the Board of Commissioners that
approximately 230 graves would be disinterred. By statute, the Lee County Board of
Commissioners will need to approve a resolution stating the County will participate
and make sure the laws are followed during the removal process. Mr. Crumpton
provided that Health Director Heath Cain would be appointed to oversee the County's
responsibility of supervising the project. The County's participation in the supervision
is required by the Legislature, however adopting the resolution is nbt an inference
that the Board is in support of the grave removals. The Department of Transportation
is required to apply through the vital records section of the register of deeds to
proceed with the grave removals. This process requires getting the information to the
closest of kin to the deceased, information has to be verified within 30 days of
complying and then has to be verified and certified once complete. Commissioner
Reives requested information regarding a family's rights to appeal in cases where a
family refuses to consent to the removal. Commissioner Reives also asked the
County Attorney to look into what the Department of Transportation would do in
relocation agreements for family members sites that are buried together or that own a
site near a family member's grave. A resolution will be brought back to the Board of
Commissioners for consideration at the March 19th meeting. Commissioner Reives
requested that the County contact the minister of the church to see if the affected
families have any questions.
Page 518
