EfooK 23 Pac 886 RESOLUTION LEASING PROPERTY FOR TWO YEARS WHEREAS, Lee County owns a parcel of real property known as 5825 Clyde Rhyne Drive and the building thereon which contains rooms and open areas for which the County has no current need; and WHEREAS, Lee County desires to use the building for the public purpose of developing its economy by conveying short -term leaseholds to small businesses likely to permanently locate or expand their operations within the County, thereby producing additional jobs and tax base. WHEREAS, the Lee County Manager and Nova Materials, LLC have tentatively agreed upon the following terms under which Nova Materials, LLC would lease approximately 3600 square feet of open space in the said building to operate a facility for the thermal processing of materials and ores and a laboratory for scientific testing relating to the process: The term would be two years beginning January 15, 2011, for the total consideration of $60,000, payable in months one through three at $500 per month; in months four through six at $1,500 per month; and in months seven through 24 at $3000 per month. Further terms would allow the County or Nova to terminated the lease upon 90 -days notice; and, WHEREAS, North Carolina General Statute § 153A -165 authorizes a county to rent or lease county -owned real property for any authorized public purpose; and, WHEREAS, the Lee County Board of Commissioners is convened in a regular meeting; NOW, THEREFORE, BE IT RESOLVED that the Lee County Board of Commissioners approves the lease of the County -owned property described above to Nova Materials, LLC under the terms described herein and directs the County Manager to execute any instrument necessary to accomplish the lease. f ADOPTED by majority vote, a quorum being present, this the I .-Y-3 of January, 2011.
