A19 FACE 858 <br />AN ORDINANCE TO REQUIRE OWNERS OF <br />PROPERTY DEVELOPED AFTER ENACTMENT <br />TO CONNECT SUCH PREMISES WITH THE <br />DISTRICT'S WATER SYSTEM <br />BE IT ORDAINED by the Board of Commissioners for Lee County sitting as the <br />governing body of the Lee County Water and Sewer District No. 1 as follows: <br />SECTION 1. Within the jurisdiction of Lee County Water and Sewer District <br />No. 1 ( "District ") every lot in all subdivisions of more than three (3) lots which are <br />approved and developed subsequent to the effective date of this ordinance that are located <br />within 1,500 feet of the District's water system, as hereinafter set out, shall be required to <br />connect each and every lot in said subdivision to the District's water system at the <br />expense of the sub - divider or developer. The distance from the closest property line of <br />the tract which is being subdivided, in whole or in part, to the nearest existing district <br />water line in a straight line shall determine whether the subject development meets the <br />criteria requiring connection to the District's water system. <br />SECTION 2. Within the jurisdiction of the District, every new residential <br />dwelling unit which is located within 1,000 feet of the District's water line system, as <br />hereinafter set out, shall connect to said system at the owners expense except when it is <br />determined that the District cannot adequately supply the customer's needs, or if the tract <br />or parcel of land on which the residential dwelling unit is situated is a land locked parcel. <br />The distance from the residential dwelling unit to the nearest existing District water line <br />in a straight line shall determine whether the residence meets the criteria requiring <br />connection to the District's Water System. <br />
