PROPOSAL FOR LEE COUNTY REGARDING LEGAL SERVICES <br />IN DEVELOPING AMENDMENTS TO UDO FOR MINING OPERATIONS <br />December 4, 2017 <br />This is a proposal by Poyner Spruill LLP for assisting Lee County (the "County") in <br />developing regulatory requirements for mining operations and for incorporating them into the Lee <br />County Unified Development Ordinance ("UDO"). <br />Procedure <br />This proposal is based on the understanding that the process for developing the Ordinance <br />generally will be as follows: <br />1. Poyner Spruill, in consultation with Lee County planning staff (the "County Staff'), <br />will analyze and recommend needed regulations and how those regulations would be incorporated <br />in the County's UDO. A report would be developed regarding the recommendations (the <br />"Report"). <br />2. The Report will be presented to the County's Board of Commissioners. The Board <br />will determine what regulations are needed and direct that the appropriate UDO amendments be <br />drafted. <br />3. Poyner Spruill will draft the UDO amendments in consultation with County Staff <br />as necessary. <br />4. Poyner Spruill , in conjunction with County Staff, will present the draft UDO <br />amendments to the Board for adoption. Any redrafting would be done by Poyner Spruill. <br />Summary of Poynerpruill LLP's Proposed Services <br />Poyner Spruill will: <br />1. Develop recommendations to the County Staff regarding regulations appropriate <br />for mining operations and how they can be incorporated in the County UDO, and prepare the <br />Report regarding the determination. <br />2. Present the Report to the County Board. <br />Draft the amendment(s) to the UDO based on direction from the County Board. <br />4. Jointly with County Staff, present the amended UDO to the Board and make any <br />revisions as directed. <br />
