The penalties that may be imposed upon employees for drug abuse violations occurring in the workplace. <br />C. Make it a requirement that each employee to be engaged in the performance of the grant be given a copy of <br />the statement required by paragraph (A); <br />D. Notifying the employee in the statement required by paragraph (A) that, as a condition of employment under <br />the grant, the employee will: <br />i. Abide by the terms of the statement; <br />ii. Notify the employer of any criminal drug statute conviction for a violation occurring in the workplace no <br />later than five days after such conviction. <br />E. Notifying the agency within ten days after receiving notice under subparagraph (D) (ii), from an employee or <br />otherwise receiving actual notice of such conviction. <br />F. Taking one of the following actions, within 30 days of receiving notice under subparagraph (D)(ii), with <br />respect to any employee who is convicted: <br />i. Taking appropriate personnel action against such an employee, up to and including termination; or <br />ii. Requiring such employee to participate satisfactorily in a drug abuse assistance or rehabilitation program <br />approved for such purpose by federal, state, local health, law enforcement, or other appropriate agency. <br />G. Making a good faith effort to continue to maintain a drug-free workplace through implementation of <br />paragraphs (A), (B), (C), (D), (E), and (F). <br />33. Execution and Effective Date: <br />This grant shall become effective upon return of this original Grant Award and MOA, properly executed on <br />behalf of the Sub -recipient, to North Carolina Emergency Management and will become binding upon execution <br />of all parties to the Agreement. The terms of this Agreement will become effective September 1, 2017. The last <br />signature shall be that of Erik A. Hooks, Secretary for the North Carolina Department of Public Safety. <br />34. Term of this Agreement: <br />This agreement shall be in effect from September 1, 2017 to February 28, 2020. <br />13 of 14 <br />
