Certification of eligibility—Under the Iran Divestment Act: <br />Pursuant to G.S. 147-86.59, any person identified as engaging in investment activities in Iran, determined by <br />appearing on the Final Divestment List created by the State Treasurer pursuant to G.S, 147-86.58, is ineligible to <br />contract with the State of North Carolina or any political subdivision of the State. The Iran Divestment Act of <br />2015, G.S. 147-86.55 et seq.* requires that each vendor, prior to contacting with the State certifies, and the <br />undersigned on behalf of the Vendor does hereby certify, to the following: <br />i. that the vendor is not identified on the Final Divestment List of entities that the State Treasurer has <br />determined engages in investment activities in Iran; <br />ii. that the vendor shall not utilize on any contract with the State agency any subcontractor that is <br />identified on the Final Divestment List; and <br />iii. that the undersigned is authorized by the Vendor to make this Certification. <br />The State Treasurer's Final Divestment List can be found on the State Treasurer's website at the address: <br />htIM://www.nctreasurer.com/inside-the-departmentLQpenGovemmment/Pages/Iran-divestment-Act-resources aspx <br />and will be updated every 180 days. For Questions about the Department of State Treasurer's Iran Divestment <br />Policy, please call (919) 814-3852. <br />24. Buy American and Hire American: <br />All recipients are required to comply with any applicable provisions of the Buy American Act (41 U.S.C. Sections <br />8301 through 8305), and any other applicable statutes, regulations, or rules that require, or provide a preference <br />for, the purchase or acquisition of goods, products, or materials produced in the United States. <br />25. Termination: <br />The terms of this agreement, as modified with the consent of all parties, will remain in effect until February 28, <br />2020. Either party upon thirty days advance written notice to the other party may terminate this agreement. Upon <br />approval by USDHS, FEMA and the issuance of the Grant Adjustment Notice, if this MOA is extended, the <br />termination date for the extension will be the date listed in the applicable USDHS, FEMA Grant Adjustment <br />Notice, incorporated by reference herein. If USDHS suspends or terminates funding in accordance with 2 CFR <br />200 and the 2017 HSGP NOFOA, incorporated by reference herein, the Sub -Recipient shall reimburse North <br />Carolina Emergency Management for said property and/or expenses. <br />26. Budget and Scone of Work: <br />Sub -Recipient shall implement the HSGP project summarized below and as described in the approved project <br />application. That application is hereby incorporated by reference into this Agreement. The Recipient shall <br />reimburse eligible costs according to the following expenditures: <br />A. Scope of Work Summary <br />Please see Attachment I for a detailed Scope of Work description. <br />C. Reports to be provided during Period of Performance <br />Sub -Recipient must also provide a semi-annual summary (progress report); no later than July 15" to the <br />NCEM Grant Manager and/or NCEM Field Planner to ensure that the project deliverables are being met, and <br />that each grant contract is operating within budget. <br />D. Reports to be provided at the Conclusion of Work (if applicable) <br />Quarterly project progress reports. <br />8of14 <br />
