bou 17 P"GE 78 RESOLUTION OF THI% BOARD OF COMMISSIONERS OF LEE COUNTY, NORTH CAROLINA WHEREAS, Martin Marietta Materials, Inc. appeared before the Lee County Board of Commissioners on July 12, 1999 and asked that the Board request the North Carolina Department of Transportation to abandon from the State road maintenance system a portion of Bruce Cog.-ins Road (SR 1156) as shown on the attached Exhibit L; and WHEREAS, the Lee County Board of Commissioners agrees that Martin Marietta's amended Special Use Permit allows for the construction of a new stone processing plant in Lee County on both sides of the existing Bruce Coggins Road (SR 1156), and the construction of a rail spur which will also cross the existing Bruce Coggins Road; and WHEREAS, the Lee County Board of Commissioners feels the public interest, convenience, and safety will be better served and protected if the designated portion of Bruce Cog-gins Road is abandoned and closed, and a new replacement road is built in the location shown on the attached map; and WHEREAS, Martin Marietta has agreed to construct the replacement road to North Carolina Department of Transportation standards at Marlin Marietta's expense, and also to construct a replacement water line to the satisfaction of the County of Lee, at Martin Marietta's expense; and WHEREAS, the Lee County Board of Commissioners is governed in this matter by North Carolina General Statute Section 136-63. NOW THEREFORE BE IT RESOLVED, that the Lee County Board of Commissioners, on petition of Martin Marietta Materials, Inc., hereby request that the Board of Transportation in making inquiry into the proposed abandonment conduct a public hearing and then if in its opinion the public interest demands it to abandon from the State maintenance system approximately 2300 feet of Bruce Coggins Road (SR 1156) in Lee County, North Carolina, from a point approximately 1100 feet southeast of its intersection with Hickory House Road (SR 1157) down to the southern boundary of the CSX railroad right-of-way, as shown on the attached map, subject to the relocation of a new road to be built at martin Marietta's expense and to DOT requirements and open to traffic, prior to the abandonment of the portion of existing Bruce Coggins Road referred to above, and subject to the relocation of the Lee County water line at Martin Marietta's expense and to Lee County's satisfaction. Adopted this the 12`r day of July, 1999.
