O2G B3 0r 8:._ WHEREAS, the operation of a motorized all terrain vehicle on private property not owned by the operator, without the consent of the owner, is a violation of NCGS 14- 159.3 and is a Class 2 Misdemeanor, and WHEREAS, the enforcement of this statute has been difficult because law enforcement officers have been unable to apprehend operators due to the ability of the motorized all terrain vehicles to operate in areas not accessible to law enforcement vehicles and as a consequence property owners are not receiving the protection contemplated by the enactment ofNCGS 14-159.3, and WHEREAS, this problem exists statewide and has been addressed by the Robeson County Board of Commissioners by a resolution adopted on June 7, 1999; NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of Lee County as follows: 1. That it supports the positions taken in the resolution adopted by the Robeson County Board of Commissioners on June 7, 1999, and joins in its petition to the General Assembly to enact statewide legislation to require registration of motorized all terrain vehicles. 2. That the legislative delegation representing Lee County in the General Assembly is requested to support and to seek enactment of statewide legislation of a registration system for motorized all terrain vehicles which will facilitate enforcement of NCGS 14-159.3.
