O2G <br />B3 0r 8:._ <br />WHEREAS, the operation of a motorized all terrain vehicle on private property <br />not owned by the operator, without the consent of the owner, is a violation of NCGS 14- <br />159.3 and is a Class 2 Misdemeanor, and <br />WHEREAS, the enforcement of this statute has been difficult because law <br />enforcement officers have been unable to apprehend operators due to the ability of the <br />motorized all terrain vehicles to operate in areas not accessible to law enforcement <br />vehicles and as a consequence property owners are not receiving the protection <br />contemplated by the enactment ofNCGS 14-159.3, and <br />WHEREAS, this problem exists statewide and has been addressed by the <br />Robeson County Board of Commissioners by a resolution adopted on June 7, 1999; <br />NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of Lee <br />County as follows: <br />1. That it supports the positions taken in the resolution adopted by the <br />Robeson County Board of Commissioners on June 7, 1999, and joins in its petition to the <br />General Assembly to enact statewide legislation to require registration of motorized all <br />terrain vehicles. <br />2. That the legislative delegation representing Lee County in the General <br />Assembly is requested to support and to seek enactment of statewide legislation of a <br />registration system for motorized all terrain vehicles which will facilitate enforcement of <br />NCGS 14-159.3. <br />
