STATE OF NORTH CAROLINA ) MODIFICATION TO <br />INTERLOCAL AGREEMENT <br />COUNTY OF LEE ) FOR SHARED USE OF THE BUGGY <br />FACTORY <br />THIS AGREEMENT, made and entered into this 5th day of September 2017, by and <br />between the County of Lee, one of the counties of the State of North Carolina and a body both <br />politic and corporate, hereinafter referred to as "County", and the City of Sanford, a municipal <br />corporation chartered by the State of North Carolina, hereinafter referred to as "City"; <br />WITNESSETH: <br />THAT WHEREAS, the County and City desire to jointly lease the property located at <br />115 Chatham Street (hereinafter "the Buggy Factory") for purposes of locating various city and <br />county departments and agencies; and, <br />WHEREAS, the City and County entered into a Lease Agreement with Bryan Bystry, <br />Progressive Development Co. LLC, for the lease of the Buggy Factory to City, County and <br />Sanford -Lee County Partnership for Prosperity, doing business as Sanford Area Growth Alliance <br />(SAGA) on September 10, 2014; and, <br />WHEREAS, it is the intent of the parties to increase efficiencies and effectiveness of all <br />aspects of development for Sanford and Lee County by co -locating the Community <br />Development, Planning, Building Inspections, Code Enforcement, Downtown Sanford, Inc., <br />Strategic Services (GIS), Environmental Health, Marketing and SAGA (Chamber of Commerce <br />and Economic Development) departments within the Buggy Factory; and <br />WHEREAS, Progressive Development Co, Inc., Landlord, has agreed to make <br />improvements to renovate the Buggy Factory to accommodate the City and County occupancy; <br />and <br />WHEREAS, by action of the Lee County Board of Commissioners and the Sanford City <br />Council, the parties hereto have indicated their intent concerning the locating of various city and <br />county departments and the Sanford -Lee County Partnership for Prosperity at the Buggy Factory. <br />NOW, THEREFORE, for and in the consideration of the payment hereinafter mentioned, <br />the mutual promises herein contained and the mutual benefits to result therefrom, and pursuant to <br />the provisions of Chapter 160A and Chapter 153A of the North Carolina General Statutes, the <br />County and City agree as follows: <br />1. TERM. The term of the Interlocal Agreement shall be for one (1) year beginning upon <br />execution and ending October 1, 2015, and shall be renewed automatically thereafter for <br />additional one (1) year terms, subject to the Parties making appropriations in keeping <br />with the agreed upon funding. If the parties do not appropriate funding on the agreed <br />upon basis, then the contract shall be extended until June 30 of the last fiscal year for <br />which appropriations were made and the City and County shall pay compensation to <br />
