C STATE OF NORTH CAROLINA ) AGREEMENT COUNTY OF LEE ) THIS AGREEMENT, made and entered into this the day of>Fy, 2001, by and between the City of Sanford, North Carolina, a municipal corporation, hereinafter referred to as "City", and The Lee County Water and Sewer District No. 1, a North Carolina municipal corporation, hereinafter referred to as "District"; WITNESSETH: WHEREAS, City and District both operate water systems within Lee County and have agreed to sell portions of their respective systems to the other entity and they desire a written document setting forth the terms of the agreement. NOW, THEREFORE, for and in consideration of the promises made and the money to be paid as herein set forth, the parties have mutually agreed as follows: ARTICLE 1 SALE TO CITY Section 1 . The District agrees to sell and the City agrees to purchase the following water lines: (a) along Pendergrass Road from the city limits to US Highway No. 1 being 6,000 linear feet, more or less; (b) all lines in the Condor Farms Subdivision being 1,925 linear feet, more or less; (c) lines along US Highway No. 1 from intersection of said highway with NC 78 at Tramway northwardly to point where city limits leaves right -of -way of US Highway No. 1, being 5,330 linear feet, more or less; (d) all lines in Owls Nest Subdivision being 9,645 linear feet, more or less; (e) together with all easements, encroachment agreements, and rights -of -way with respect to said lines. The lines are show on Exhibit "A" attached hereto and to which reference is hereby made for greater certainty of description. _
