6u01 Y'GE ~$j <br />A RESOLUTION ORDERING THE CLOSI G OF AN UNOPENED PORTION OF WEST MEADOWBROOK STREET <br />WHEREAS, on the 201h day of November, 2000 the Lee County Commissioners <br />directed the County Clerk to publish the Resolution of Intent of the County <br />Commissioners to consider closing public roads in Lee County in the Sanford Herald <br />newspaper once each week for three successive weeks, such resolution advising the <br />public that a meeting would be conducted in the Lee County Government Center on <br />January 2, 2001; and <br />WHEREAS, the Lee County Commissioners, on the 201h day of November, 2000 <br />ordered the County Clerk to notify all persons owning property abutting an unopened <br />portion of West Meadowbrook Street; and <br />WHEREAS, the County Clerk has advised the Lee County Commissioners that on <br />the date directed she sent a letter to each of said abutting property owners advising them <br />of the day, time, and place of the meeting, enclosing a copy of the Resolution of Intent <br />and advising said abutting property owner that the question as to closing that unopened <br />portion of West Meadowbrook Street would be acted upon at the January 2°d, 2001 <br />meeting, said letters having been mailed by registered mail with return receipt requested; <br />and <br />WHEREAS, the County Clerk has advised the Lee County Commissioners that <br />none of the letters so sent have been returned undelivered; and <br />WHEREAS the County Clerk has published the resolution as directed in the <br />Sanford Herald once a week for three consecutive weeks; and <br />WTIEREAS, after full and complete consideration of the matter and after having <br />granted full and complete opportunity for all interested persons to appear and register any <br />objections that they might have with respect to the closing of said street; and <br />WHEREAS, it now appears to the satisfaction of the Lee County Commissioners <br />the closing of said street is not contrary to the public interest and that no individual <br />owning property, either abutting the street or in the vicinity of said street or in the <br />subdivision in which said street is located, will as a result of said closing, be thereby <br />deprived of a reasonable means of ingress and egress to his property, and <br />WHEREAS, the County of Lee reserves its right, title and interest in any utility <br />improvement or easement within the street, if any; and <br />WHEREAS, it appears to the satisfaction of the Lee County Commissioners that <br />the closing of said street will be in the public interest. <br />NOW THEREFORE, BE IT RESOLVED by the Lee County Commissioners <br />meeting in regular session that the unopened portion of West Meadowbrook Street, <br />beginning at a point 242.5 feet south from the Pioneer Drive and West Meadowbrook <br />Street intersection and extending south west approximately 700 feet is hereby ordered <br />closed, and all right, title, and interest that may be vested in the public to said area for <br />street purposes is here by released and quit-claimed to the abutting property owners in <br />accordance with the provisions of Section 153A-241 of the General Statutes of North <br />Carolina. <br />
