For the purposes of applying setbacks to an existing developed lot, the front <br />yard setback shall be defined as the yard with the shortest amount of street frontage. <br />All other frontages shall be considered street side yards acrd the rear yard shall be that <br />yard that is opposite the designated front yard. For the purposes of deterneining <br />setback distance, a street side yard shall be considered the same as a front yard and <br />shall meet the respective front yard setback. <br />Amendment 3 — Section 5.20 of the UDO includes additional design standards that are <br />applied to proposed new sanitary landfills. Section 5.20.2.4 specifically addresses standards <br />for ingress and egress. During recent review of a proposed five acre LCID (land clearing and <br />inert debris/"stump dump ") landfill, staff discovered current language that is too vague and is <br />in conflict with City's Public Works policies. <br />Please note that the Joint Planning Commission (JPC) met on Sept. 23, 2010 to review this <br />proposed amendment. The JPC recommended that the proposed amendment be forwarded to <br />all three jurisdictions for consideration of adoption. <br />Draft language for consideration (changes in Italics): <br />5.20.2.4 Ingress to and egress from sanitary landfill facilities shall be permitted <br />by roads to serve only the solid waste facilities. Within the unincorporated areas of <br />the County, such roads shall be desi-ned and constructed to North Carolina Secondary <br />Road Standards. Approach <br />and departure traffic routes for a sanitary landfill facility shall not be permitted <br />through streets primarily intended to provide access for a residential neighborhood. <br />Amendment 4 — Section 6.7.1 of the UDO addresses certain of street design as it relates to <br />new subdivisions. More specifically, Section 6.7.1.4 addresses cul -de -sac street design. At <br />recent TRC (Technical Review Committee) meetings, Mr. Ken Cotton of the Sanford Fire <br />Department brought forward a concern that the current width requirement for the radius on <br />cul -de -sac streets is to small. Due to the size of the Fire Department's response vehicles, Mr. <br />Cotton indicated a need to increase the pavement radius from the current of 40 feet (80' <br />diameter) to 45 feet (90' foot diameter). Mr. Bill Rogers, Lee County Fire Marshal, agrees <br />with Mr. Cotton's concerns and is also recommending this change for Lee County and the <br />Town of Broadway. Please note that an increase in the pavement width will also necessitate <br />an increase in the width of the right -of -way for the cul -de -sac bulb from the current 90 foot <br />diameter to a 100' diameter. <br />11 <br />3 <br />
