C�?3 <br />ARTICLE II. NOISE <br />r� <br />Sec. 12 -31. Purpose, statutory authority, and name of Article. <br />The purpose of this article is to regulate, restrict and, wher :;pec p Abit or abate <br />the production and emission of amplified speech, music and other n" nHsounds in the <br />unincorporated areas of the county that tend to annoy, disturb, or frighten citizens. This Article <br />is adopted pursuant to the authority contained in G.S. 153A -133, G.S. 153A -123 and G.S. 14 -4 <br />and shall be known as the Lee County Noise Control Ordinance. <br />Sec. 12-32. Definitions. <br />In addition to the common meaning of words, the following definitions shall be used in <br />interpreting this Article. <br />(a) "A" weighting scale. The sound pressure level, in decibels, as measured with the <br />sound level meter using the "A" weighted network (scale). The standard unit notation is <br />dB(A). <br />(b) Ambient background sound level. The average sound pressure, measured by <br />dB(A), normally present at a location when a sound source under investigation is not <br />® present as determined by employing a sound level meter as described in section 12 -36, <br />excluding repetitive impulsive sounds . <br />(c) ANSI. The American National Standards Institute or its successor bodies. <br />(d) Classification of lond use. For the purpose of defining the "land use" as used in <br />this Article, and notwithstanding how property may be zoned, all premises containing <br />regularly occupied sleeping quarters shall be considered as residential land use areas, <br />including, but not limited to, hospitals, nursing homes, rest homes, assisted living <br />centers, hotels, motels, dormitories, and campgrounds. Schools, libraries, and churches <br />uses shall be considered residential uses. All premises containing businesses where <br />sales, professional, or other commercial use is legally permitted shall be considered <br />commercial use. All premises where industry is legally permitted shall be considered <br />industrial use. <br />(e) Construction. On -site erection, fabrication, installation, alteration, demolition or <br />removal of any structure, facility or addition thereto, including all related activities such <br />as clearing of land, earth moving, blasting and landscaping: <br />(f) Commercial land use area. Any tract or parcel of land zoned or regularly used for <br />commercial, office, or institutional purposes including retail sales and government <br />® facilities, but not including those uses that offer a place for sleeping such as hospitals, <br />1 <br />
