A. <br />_ Information <br />Meeting Date: October 4, 2010 XX Action Item <br />Consent Agenda <br />SUBJECT Amendment to Lee County Noise Ordinance <br />DEPARTMENT Countywide <br />CONTACT PERSON Dick Hoyle; Dale Talbert <br />REQUEST Consider, and potentially take second vote on amended ordinance <br />SUMMARY At the September 20, 2010 meeting of the Board, a proposed <br />comprehensive amendment to the County's existing Noise Ordinance <br />that would establish a scientific, objective limit on noise, measured in <br />decibels, was introduced and debated. Upon motion of <br />Commissioner Oldham and majority vote of the Board, Sec. 12- <br />34(a)(3), setting out exceptions to the subjective and objective noise <br />limits, was amended to exempt noise emanating from construction <br />equipment at any time. The proposed new ordinance, as amended in <br />open session, was approved by a majority vote of the Board. <br />BUDGET IMPACT N/A <br />ATTACHMENT(S) Amended Lee County Noise Ordinance <br />PUBLIC HEARING No <br />PRIOR BOARD ACTION N/A <br />RECOMMENDATION To be ratified, the ordinance must pass by a second majority vote. It <br />will be effective on the date of ratification or on a subsequent date, if <br />directed by majority vote the Board. <br />Recommend ratification the proposed ordinance as amended to be <br />effective immediately upon ratification. <br />
