is oK I8 PIGF 3,5% ® 1.3 <br />AN ORDINANCE ANIENDING THE ZONING ORDINANCE <br />OF LEE COUNTY, NORTH CAROLINA <br />BE IT ORDAINED by the Board of Commissioners of Lee County, North Carolina that the <br />Zoning Ordinance be, and it hereby is, amended as follows: <br />Item 1. Amend the Lee County Zoning Ordinance, by adding a new Article XIV, "Buffering and <br />Screenim," as follows: <br />Article XIV <br />Buffering and Screening <br />Section 1. Purpose and Intent of Buffer Yards. <br />The Lee County Board of Commissioners has determined that requiring buffer and screening <br />standards will protect the health, safety, and general welfare of the public, and maintain and <br />enhance the appearance of the community. These buffer and screening regulations are therefore <br />established herein to minimize potential nuisances such as the transmission of noise, (lust, odor, <br />litter, and glare of lights; to reduce the visual impact of the unsightly aspects of adjacent <br />(levelopment; to provide for the separation of spaces; and to establish a sense of privacy. Buffers <br />shall be required to separate proposed development from adjacent major streets and different <br />adjacent land uses or zoning determinations. The buffer and screening requirements will be <br />applied to all new development, redevelopment or building expansion projects. <br />Section 2. Buffers Required. <br />a) A buffer is a strip of land together with the landscaping and screening required thereon. <br />Except as otherwise specifically provided in this subchapter, the type of buffer required between <br />a proposed development and adjacent streets, land uses or zoning designations shall be as <br />specified in Section 5, Schedule For Required Buffers. <br />b) Width and screening specifications for each buffer type shall be detailed and illustrated in the <br />Appendix A to this chapter. Screening required within buffers is intended to provide separation <br />of spaces without necessarily eliminating visual contact between the spaces, and may consist of <br />existing vegetation, planted vegetation, a landscaped earth berni, a decorative wall, a wood fence, <br />or a combination of the above. Any of the options specified in the Appendix A for the required <br />buffer type shall satisfy the buffer requirements of this section. <br />Section 3. Location of Buffers. <br />Required buffers shall be located along the interior or street lot lines nearest the adjacent streets, <br />land uses, or zoning designations except where such lot lines are intersected by crossing <br />accessways or utility easements, or by a joint parking area. Buffers shall not be located on any <br />portion of an existing or proposed street right-of-way or easement. <br />
