LEE <br />COUNTY <br />Committed Today for a Better Tomorrow <br />RESOLUTION APPROVING UPSET BID FOR THE SALE <br />OF SURPLUS PROPERTY LOCATED AT 109 S. THIRD STREET IN THE CITY OF <br />SANFORD, LEE COUNTY <br />WHEREAS, the County of Lee owns certain property located at 109 s. Third Street, Lot 7 <br />Charlotte Avenue Neighborhood, PIN 9643-80-9474-00, Sanford, Lee County, NC as shown on <br />a deed recorded in Deed Book 1435 Page 509 in the Office of the Register of Deeds for Lee <br />County, to which the record thereof, reference is hereby made for more complete description; <br />and, <br />WHEREAS, North Carolina General Statutes §§ 153A-176 and 160A-269 permit the <br />county to sell property by upset bid, after receipt of an offer to purchase the property; and, <br />WHEREAS, The City of Sanford deeded its interest in the property to the County in <br />order to dispose of the property on behalf of the City of Sanford and to recoup some of the costs <br />incurred in collecting taxes, as shown on a deed recorded in Deed Book 1462 Page 129, in the <br />Office of the Register of Deeds for Lee County; and, <br />WHEREAS, the County received two original offers, one submitted by Curtis Lawrence <br />on behalf of WIT'S Remodeling, to purchase the property described above in the amount of <br />$10,545.65 and one submitted by Cristian Campos to purchase the property for $10,100.00; and, <br />WHEREAS, Mr. Lawrence and Mr. Campos paid to the County the required 5 percent <br />(5%) deposit on its offer and advertising costs; and, <br />WHEREAS, the Lee County Board of Commissioners accepted the offer of $10,545.65 <br />from Mr. Lawrence at the Board's regular meeting on June 5, 2017; and, <br />WHEREAS, the offer was advertised in The Sanford Herald on June 14, 2017; and, <br />WHEREAS, Cristian Campos submitted a first upset bid in the amount of $12,100.00 <br />(which was at least 10% of the first $1,000 and 5% of the remainder of Mr. Lawrence's original <br />offer) on June 16, 2017; and, <br />WHEREAS, Mr. Campos paid the required advertising costs and along with his original <br />bid deposit, has paid the required five percent deposit on his new offer; and, <br />WHEREAS, Mr. Campos' upset bid was advertised in The Sanford Herald on August 2, <br />2017; and, <br />
