~7 <br />eooA 18 r~cE 50 <br />602 <br />The Chairman ruled the motion had been adopted unanimously. <br />The Board considered a revised fee schedule for the Planning Department. <br />Community Development Director Ron Satterfield updated the Board on the discussion <br />that took place at the July 9, 2001 meeting. He told the Board that his request to increase <br />application fees associated with conventional rezoning requests, conditional use rezoning <br />requests, special use requests, variance requests, and appeals from the zoning <br />enforcement officer were tabled at that meeting. Community Development staff were <br />directed to meet with the County Attorney to discuss the amount of information included <br />in legal notices advertised in The Sanford Herald. Mr. Satterfield told the Board that his <br />request at the last meeting was to increase fees from $50.00 to 5125.00 per request. After <br />researching the matter, Mr. Satterfield has learned that Article X111, Section 5, <br />(subparagraph d) of the Lee County Zoning Ordinance states, "There shall be a fee <br />payable to Lee County for each application for rezoning. The amount of said fee shall be <br />fixed by the Board of County Commissioners and shall be sufficient to defray all <br />administrative costs incurred in processing the application, notifying adjacent property <br />owners, obtaining technical assistance, and publishing notice of public hearing." Mr. <br />Satterfield told the Board that based on the Zoning Ordinance, he recommends the <br />following revised fee schedule: <br />Current Fee <br />Proposed Fee <br />Rezonings <br />S50.00 <br />$ 250.00 <br />Special Use Requests <br />550.00 <br />$ 250.00 <br />Variances <br />550.00 <br />S275.00 <br />Appeals <br />S50.00 <br />$ 275.00 <br />He stated that the rezoning and special use fee would defray the cost of advertising <br />($135.00), mailed notices ($5.00), staff time ($50.00, detennined at an average of 5 hours <br />at 520.00/hour), and planning board member salaries ($60.00 at 5175.00/meeting divided <br />by an average of 3 cases per meeting). The variance and appeal fee would defray the cost <br />of advertising ($150.00), mailed notices ($5.00), staff time (522.50 detennined at an <br />average of 3 hours at $15.00/11our) and Board of Adjustment member salary <br />($125.00/meeting for an average of one case per meeting). He told the Board that staff <br />had met with Attorney K. R. Hoyle regarding the amount of information included in the <br />legal notices published by The Sanford Herald. After reviewing what Lee County <br />currently advertises, Mr. Satterfield and Mr. Hoyle feel that the notices comply with the <br />minimum requirements for advertising notices and no information should be eliminated. <br />After much discussion, Commissioner Adams moved to increase rezoning and special use <br />requests from S50.00 per request to 5200.00 per request, and variances and appeals from <br />$50.00 per request to $225.00 per request. Upon a vote, the results were as follows: <br />Aye: Adams, Hincks, and Sauls <br />Nay: Lemmond, Matthews, Paschal, and Reives <br />The Chairman ruled the motion had failed with a four to three vote. <br />2 <br />
