Community Development Director Ron Satterfield updated the Board on the discussion that took place at the July 9, 2001 meeting. He told the Board that his request to increase application fees associated with conventional rezoning requests, conditional use rezoning requests, special use requests, variance requests, and appeals from the zoning enforcement officer were tabled at that meeting. Community Development staff were directed to meet with the County Attorney to discuss the amount of information included in legal notices advertised in The Sanford Herald. Mr. Satterfield told the Board that his request at the last meeting was to increase fees from $50.00 to 5125.00 per request. After researching the matter, Mr. Satterfield has learned that Article X111, Section 5, (subparagraph d) of the Lee County Zoning Ordinance states, "There shall be a fee payable to Lee County for each application for rezoning. The amount of said fee shall be fixed by the Board of County Commissioners and shall be sufficient to defray all administrative costs incurred in processing the application, notifying adjacent property owners, obtaining technical assistance, and publishing notice of public hearing." Mr. Satterfield told the Board that based on the Zoning Ordinance, he recommends the following revised fee schedule: Current Fee Proposed Fee Rezonings S50.00 $ 250.00 Special Use Requests 550.00 $ 250.00 Variances 550.00 S275.00 Appeals S50.00 $ 275.00 He stated that the rezoning and special use fee would defray the cost of advertising ($135.00), mailed notices ($5.00), staff time ($50.00, detennined at an average of 5 hours at 520.00/hour), and planning board member salaries ($60.00 at 5175.00/meeting divided by an average of 3 cases per meeting). The variance and appeal fee would defray the cost of advertising ($150.00), mailed notices ($5.00), staff time (522.50 detennined at an average of 3 hours at $15.00/11our) and Board of Adjustment member salary ($125.00/meeting for an average of one case per meeting). He told the Board that staff had met with Attorney K. R. Hoyle regarding the amount of information included in the legal notices published by The Sanford Herald. After reviewing what Lee County currently advertises, Mr. Satterfield and Mr. Hoyle feel that the notices comply with the minimum requirements for advertising notices and no information should be eliminated. After much discussion, Commissioner Adams moved to increase rezoning and special use requests from S50.00 per request to 5200.00 per request, and variances and appeals from $50.00 per request to $225.00 per request. Upon a vote, the results were as follows: Aye: Adams, Hincks, and Sauls Nay: Lemmond, Matthews, Paschal, and Reives The Chairman ruled the motion had failed with a four to three vote. 2
