6COX 148 P'GF 5760 <br />Decisions of the Planning Board regarding alternate methods of compliance may be <br />appealed to the Lee County Board of Adjustment. <br />Section 4. Administrative Provisions. <br />a) Plan Required. Landscape plans for buffers and screening shall be presented to the <br />Zoning Administrator along with an application for a building permit. The buffer shall be <br />planted and fencing or other barriers constructed as required prior to the issuance of a <br />certificate of occupancy. <br />b) Performance Guarantee. When the planting season is not appropriate, a developer <br />may request a temporary Certificate of Occupancy. A temporary Certificate of Occupancy <br />may be issued for occupancy of a structure or initiation of a use prior to the installation or <br />completion of the buffer and/or other landscaping upon acceptance of a guarantee in the <br />form of a certified check or letter of credit submitted to the Sanford/Lee County Planning <br />Department. Such guarantee shall be in an amount sufficient to the cover the cost of the <br />installation of the buffer. The developer shall submit an estimate of the cost from a <br />landscape contractor. <br />C) Maintenance. All required buffering and screening shall be maintained so as to <br />continue their effectiveness. <br />d) Violations. Failure to maintain the buffer or to adhere to an approved landscaping <br />plan shall constitute a zoning violation. Such violation will be subject to penalties set forth <br />in Article XIII, Section 8." <br />Section 2. This Ordinance shall be in full force and effect from and after the date of its adoption. <br />Upon a motion by Commissioner Jerry Lemmond and seconded by <br />Commissioner N/A , this ordinance was duly adopted this <br />the 4th day of September 2001. <br />C29 <br />Herbert A.
