BGOn ~8 hasE 574ift <br />0 %V <br />AN ORDINANCE AMENDING THE ZONING ORDINANCE 1 l <br />OF LEE COUNTY, NORTH CAROLINA <br />BE IT ORDAINED by the Board of Commissioners of Lee County, North Carolina that the <br />Zoning Ordinance be, and it hereby is, amended as follows: <br />Section 1. Amend Article XIV, "BUFFERING AND SCREENING" by repealing it in its entirety <br />and replacing it with a new Article XIV, "BUFFERING AND SCREENING" as follows: <br />Article XIV <br />BUFFERING AND SCREENING <br />"Section 1. Purpose and Intent of Buffer Yards. <br />It is the intent of Lee County to require buffer and screening standards that will protect <br />the health, safety, and general welfare of the public, and maintain and enhance the <br />appearance of the community. The buffer and screening regulations are established <br />herein to minimize potential nuisances such as the transmission of noise, dust, odor, <br />litter, and glare of lights; to reduce the visual impact of the unsightly aspects of adjacent <br />development; to provide for the separation of spaces; and to establish a sense of privacy. <br />Buffers shall be required to separate proposed development from different adjacent land <br />uses or zoning determinations. The buffer and screening requirements will be applied to <br />all new development, redevelopment, or building expansion projects. <br />Section 2. Buffers Required. <br />a) A buffer strip shall be provided between residential and nonresidential uses and <br />between single-family uses and multifamily uses containing four or more units. The <br />following shall be the minimum buffer strip requirements: <br />(1) Where the adjacent or abutting lot has been or can be developed for a <br />residential use lying within 120 feet of the use for which buffering is <br />required, the required buffers and screening shall be planted as follows: <br />a. One row of deciduous trees or evergreen trees spaced not more than 25 <br />feet apart and located approximately in the center of the buffer. <br />Deciduous trees shall have a minimum height of six feet and evergreen <br />trees shall have a minimum height of three feet when planted. <br />b. Two rows of evergreen shrubs shall be planted on the side of the buffer <br />facing the residentially zoned lots. These rows shall be no more than <br />three feet apart and the shrubs shall be planted in a staggered pattern no <br />more than six feet apart. These shrubs shall be of a size and species <br />that will grow to a height of five feet or more after one full growing <br />season and will eventually grow to a height no less than 12 feet. <br />
