NOX 18 P,CE 573 40 <br />AN ORDINANCE AMENDING THE SUBDIVISION REGULATIONS 02G <br />OF LEE COUNTY, NORTH CAROLINA <br />BE IT ORDAINED by the Board of Commissioners of Lee County, North Carolina that the Subdivision <br />Regulations be, and they hereby are, amended as follows: <br />Section 1. Amend Article V, DEFINITIONS, Section B. Additional Definitions, Paragraph 22, <br />Subdivision, Minor-Large Lot by repealing it in its entirety. <br />Section 2. Amend Article V, DEFINITIONS, Section B. Additional Definitions, Paragraph 21, <br />Subdivision, Minor, by repealing it in its entirety and replacing it with a new definition of"Subdivision <br />Minor" to read as follows: <br />"Subdivision, Minor. <br />Any subdivision which contains not more than six (6) lots with frontage on an existing, <br />publicly-maintained street, and does not involve the extension of any public or private street <br />for access to interior property; does not involve the extension of public water, sewer, or other <br />public improvements; does not adversely affect the remainder of the parcel or adjoining <br />property; or require a variance from any requirement of this ordinance. <br />2. Any subdivision which contains not more than three (3) lots, and does not involve the <br />extension of any public or private street for access to interior property; does not involve the <br />extension of public water, sewer, or other public improvements; or require a variance from any <br />requirement of this ordinance, provided that: <br />a) No lot is less than the required minimum lot size of the respective zoning district. <br />b) Access to interior lots is provided by a perpetual, private access easement, which has a <br />minimum cleared width of 30 feet, and connects directly to an existing publicly maintained <br />road. <br />c) Each lot fronts or abuts the private access easement or an existing, publicly maintained <br />road. <br />d) No more than three (3) lots are created along the 30-foot easement." <br />Section 3. This Ordinance shall be in full force and effect from and after the date of its adoption. <br />Upon a motion by Commissioner <br />Chad Adams and seconded by Commissioner <br />this ordinance was duly adopted this the 4th day of <br /><2~,~42 2~_ <br />Herbert A.
