STATE OF NORTH CAROLINA <br />COUNTY OF LEE CONTRACT FOR FIRE MARSHAL AND <br />FIRE INSPECTION SERVICES <br />THIS AGREEMENT dated this day of ~ 2002, by and <br />between the County of Lee, one of the hundred counties o the State of North Carolina <br />and a body both politic and corporate, hereinafter referred to as "County", and the City of <br />Sanford, a municipal corporation charted by the State of North Carolina, hereinafter <br />referred to as "City"; <br />WITNESSETH: <br />WHEREAS, the parties hereto have entered into an agreement dated August 20, <br />2002, for the City to provide inspection services to the County; and <br />WHEREAS, the County's building inspections personnel have performed the <br />duties of fire marshal and conducted fire inspection services to residents in Lee County; <br />and <br />WHEREAS, the Contract for Inspection Services does not address the provision <br />of fire inspection and fire marshal services; and <br />WHEREAS, the parties hereto agree for the City to provide fire inspection and <br />fire marshal services to Lee County residents; and <br />WHEREAS, NCGS§ 153A-234 allows the County to appoint a fire marshal. <br />NOW, THEREFORE, for and consideration of the Agreement of both parties to <br />enter into the Contract for Inspection Services and to provide for the most efficient means <br />to offer services to the citizens of the City of Sanford and the County, the parties hereto <br />agree as follows: <br />In accordance with NCGS§153A-234, and existing laws, rules, and <br />regulations, the City agrees to provide the services of fire inspection and fire <br />marshal which are now performed by County inspection personnel at no <br />additional cost to county residents, except for fees collected and paid in <br />accordance with the Contract for Inspection Services. <br />2. The City agrees to continue the service using essentially the same personnel <br />(Travis Phillips and James Collins), to the extent possible, provided the <br />County is willing to appoint Travis Phillips as the County Fire Marshal. <br />3. The term of this Agreement shall begin September 1, 2002, and shall end on <br />June 30, 2003. <br />
