O~W\ <br />STATE OF NORTH CAROLINA ) <br />COUNTY OF LEE ) <br />CONTRACT FOR INSPECTION SERVICES <br />THIS AGREEMENT, made and entered into this 5?0 day of alt 2002, by and <br />between the County of Lee, one of the one hundred counties of the State of 14orth Carolina and a <br />body both politic and corporate, hereinafter referred to as "County", and the City of Sanford, a <br />municipal corporation chartered by the State of North Carolina, hereinafter referred to as "City"; <br />WITNESSETH: <br />THAT WHEREAS, the County desires for the City to provide inspection services for <br />County by and through its Community Development Department housed in the Federal Building <br />located at 226 Carthage Street, Sanford, N.C.; and <br />WHEREAS, the City has agreed to provide such services for the County; and <br />WHEREAS, by action of the Lee County Board of Commissioners and the Sanford City <br />Council, the parties hereto have reached an agreement concerning the provision of building <br />inspection services to the County; <br />NOW, THEREFORE, for and in the consideration of the payment hereinafter mentioned, the <br />mutual promises herein contained and the mutual benefits to result therefrom, and pursuant to the <br />provisions of Chapter 160A and Chapter 153A of the North Carolina General Statutes, the County <br />and City agree as follows: <br />TERM. The tens of this agreement shall begin September 1, 2002 and end June 30, 2003, and <br />shall be renewed automatically thereafter for additional one (1) year terms if the parties agree <br />upon a budget for said department and make appropriations in keeping with the agreed upon <br />division of funding. If the parties cannot agree or do not appropriate funding on an agreed <br />upon basis, then the contract shall be extended for a period of six (6) months and the County <br />shall pay compensation to the City on the same basis that it paid for that period in the <br />preceding fiscal year adjusted for inflation in accordance with the January Consumer Price <br />Index for the South region as reported by the Bureau of Labor Statistics, Southeastern <br />Regional Office for the category of all urban consumers, all items group. On or about April 1, <br />City will provide County with a budget estimate for the coming fiscal year for the Building <br />Inspection Department and a proposed division of funding. <br />2. SERVICES. The City agrees to provide the County comprehensive inspection services <br />including administration of the North Carolina Building Code and any ancillary services <br />promulgated by the City Manager in concert with the County Manger. City will provide day- <br />to-day management of all department operations by the Community Development Director <br />under the direction of the City Manager. Any person having a complaint concerning <br />inspection services may direct it to the County Manager. County agrees to follow <br />departmental protocol for all citizen complaints. <br />3. AUTHORIZATION. County agrees that the City of Sanford Community Development <br />employees shall be authorized to enforce all building inspection regulations in the County in <br />
