FOR A CONDITIONAL ) ORDER <br />USE PERMIT ) <br />APPLICATION NO. 2002-0601 <br />) <br />THIS MATTER coming on to be heard by the Lee County Board of <br />Commissioners on June 24, 2002 on the application of David H. Simpson Construction <br />Co., Inc. for the rezoning of a 1.53 acre, more or less, portion of a four acre tract or parcel <br />of land located at 3005 Beechtree Drive, Sanford, N.C., from Residential Agricultural <br />District to Highway Commercial Conditional Use District and for the issuance of a <br />Conditional Use Permit to allow for the placement of buildings and related uses <br />associated with a boat dealership. The Board of Commissioners and the Planning Board <br />held a joint public hearing upon this application on June 17, 2002 at which time Mr. Tim <br />Pilson, owner of the property appeared, and Mr. David Taylor, an adjoining landowner, <br />also appeared and expressed his concern about the application. The Lee County Planning <br />Board has recommended approval of the Rezoning and the Conditional Use Permit for <br />the placement of buildings and related uses associated with a boat dealership. <br />Based upon the evidence presented, the Board of Commissioners makes the <br />following findings: <br />(1) that the use will not materially endanger the public health or safety if <br />located where proposed and developed according to the application and <br />plan as submitted and approved; <br />(2) that the use meets all required conditions and specifications; <br />
